Payment in lieu of notice problem.

Hi everyone, first time on forum.

The problem I have is that I was made redundant after 16 years on 21st December 2012 as the company went into liquidation. So no redundancy or payment in lieu paid by my employer. I signed on for job seekers.

Today (04/01/2013) I have been sent a 'redundancy payment claim form' by the Liquidator, in the form it asks "Have you had a new job since you were made redundant?" "Yes Or No". The answer is at the moment is No but, luckily, as of Monday I'm starting a new job.

The problem is, not wanting to fill the form in wrong,
1. Am I at this moment employed or not?

2. How does this effect me in claiming my payment in lieu which would be paid by the Government, will I still get this or will I lose it? Also my new job is paying less money than I was on before.

I hope this is clear, and I would be grateful for any help.

    I'm not an expert, but I would fill in the form with your status today: ie. you are not employed (yet).

    I'd check the small print in case there is a requirement to tell them if your circumstances change.

    Put no as at the time you complete the form you aren't. However, you will be sent a further form later (RP2) after your notice period has expired which asks the same questions in relation to notice pay about new employment and if you have claimed any benefits (JSA etc). The part of your notice that you have not worked is a damages claim for breach of contract and is calculated like a compensation payment. This means that any wages you get from a new job or any benefits you were entitled to (even if you did not claim them) will be deducted.. This part is not taxable, although basic tax is taken into account when calculating the amount due to you.
