I have written to them on 2 occasions and need the item by tomorrow
I do not see the intended recipient until next year
so there is no point in accepting it after today

I am fully aware of the backlogs at christmas with regard to deliveries, but it does not take that long to deliver 1 bar of soap

I was probably not 100% correct in my answers but i was just trying to get a quick resolution to my particular predicament and was put on the spot!. I am therefore not sure about my legal rights as to distance selling in this case as i cannot seem to find answers to payment through Amazon credit. Although i hope i am right in not accepting the goods. I believe i have an entitlement to refuse them, and that returning a bar of soap to the seller will probably cost me more than its worth!.

Amazon didn't sell this item, so although they have some obligations (which they fulfil well in my view) you would need to cancel the order with the seller.0

The 7 days to return an item bought online (or over phone etc) starts the day AFTER your item is DELIVERED - not ordered. Wait till it shows - if you don't want it then claim refund back via the DSR then.0

You seriously need to brush up on your DSR's. Your 7 days beliefs are miles off.
Are you saying that you paid for next day delivery or do you qualify for next day delivery through prime?
I am not aware of Marketplace sellers providing a delivery commitment on checkout - in fact on doing a dummy order it offers me a number of days for delivery. Not a fixed date delivery.

You misunderstood the postage arrangements. The item you ordered was available direct from Amazon, in which case you could have opted for Prime/ next day delivery, but you ordered from a marketplace seller instead.

Yes you are probably correct, it was not wise of me to reply with lol, yet it was a spur of the moment thing as i found the standard reply she gave amusing and expected. It probably doesnt help on my part that my wife is awaiting late delivery of 2 items atm from amazon, and we are not happy with their service which may have swayed my answers slightly toward the light hearted replies given to the expected standard retort of the lady helper.p.s. if you replied with 'lol' when I was trying to assist you I would be less than helpful towards you.
The item was £5 so am i expected to accept the item and then pay for the return postage?. You can simply refuse delivery, no need to pay for the return postage that way.

She did know more on the matter :P She knew you have no DSR rights with amazon as your contract is with a another party, which is more than you knew
Its no different to buying something off ebay. You dont enter into a contract with ebay themselves, you enter into a contract with a seller who happens to advertise on ebay.
