Cheated by BUY IT DIRECT

Yesterday, I purchased a tablet that was brand new and for sale on eBay from a company called "www.buyitdirect.co.uk". They took my payment via paypal and this morning I got this email from them:

Thank you for your order.
We regret to inform you that part of your order is no longer available from our suppliers. Occasionally we will experience a time delay on product information, whereby a manufacturer will no longer have stock and will discontinue a product before we are able to update our systems.
Our Sales Team will be in touch shortly to discuss alternatives. Our expert team will, wherever possible, be able to offer you a similar product to your first choice.
You are under no obligation to change your order and have the option of a full refund. We do however recommend speaking to our team first as we can normally offer an alternative to meet the same criteria and needs.
Our apologies for any inconvenience this may have caused. If you need any further assistance you can contact us on 0844 412 4550.

I called them immediately and they told me that they were "sorry" (B.S.) and that I could have a refund in 48 hours. I told them that they didn't have to wait 48 hours on my buy it now payment and that I demanded the money back now. They refused, so I contacted paypal and this is the letter they sent them:

I would highly recommend you issue the refund with immediate effect as the buyer paid in good faith and the payment completed to you on the same day 2nd January 2012.

Failure to do so will result in the creditor filing a dispute against you or a credit card chargeback.

This email came through to me whilst I was on the phone to them for a 2nd time, only this time they said they had to put me on hold. They then told me that they'd cancelled the order and that they'd send me an email:


Order Received | Order Cancelled


Dear Steve *************,
Your order has been cancelled.
This may be due to one of the following reasons:
  • You have requested we cancel the order
  • We may be experiencing problems with your payment
  • We have not been able to contact you about your order on the contact details provided
If your payment has been taken we will refund the full amount automatically without you taking any further action. The refund can take 7-10 working days depending on who you bank with in line with the normal banking system.
If there is anything else we can help with, please contact us using the easy eMessage service.

When I questioned them about the 7 to 10 working days for my refund, they told me "Sorry sir, there's nothing we can do about it"

Needless to say I got mad and demanded my money back right away and the guy said "Sorry sir, there's nothing we can do about it"

I kept on and he once more said "Sorry sir, there's nothing we can do about it"

And one final time "Sorry sir, there's nothing we can do about it".

Now, it doesn't end here. They're STILL advertising this item as in stock on the eBay:

    The money may not have actually left your account the same day - there may simply have been a holding marker on it. And when an order is cancelled then the retailer have (by law - Distance Selling Regulations) up to 30 days to provide the refund. So 7-10 days is not unusual. (It CAN be done same day, depending on who you bank with and who they bank with).

    Annoying? Yes. Worth a Drama Llama scenario? Probably not.

  • But Buy It Direct haven't cheated you as they are acting well within the time that the law allows for them to refund you.

    The 7-10 days for the money to get into your bank account isn't something that BID have any control over. All they can do is to refund your original paypal payment. What happens after that is down to paypal and your bank.

    So, you're telling me it's lawful for traders to put items on eBay that they don't have?

    In THAT respect it's dubious (false advertising), but is something for Ebay to take up - you HAVE reported it to them haven't you?

    It's cheaper at Ebuyer, but pre-order.
