    No, provided you are not intending to make the contents of the communication available to a third party. If you are you will need the consent of the person you are recording.

    No, as Gloomendoom has confirmed, you don't have to tell them anything at the start of the conversation...the only time you need to tell them is if you plan to give the conversation recording to a third party or you plan to use it for commercial purposes.

    You will notice that companies will blag you and tell you a load of porkies, such as "oh your supposed to tell us beforehand if you are going to record the conversation"...this is a LIE!

    Many tend to quickly end the call or won't continue with the conversation as soon as you mention that your going to record their call as they know that if they lie, they will be liable.

    Remember, don't tell them your recording and also whilst recording take the person's FULL details, so that when you do mention that they are being recorded, you can go back to them/or their management if they cut you off.

    My advice to you would be to contact them stating that your not happy at all. Make a call to the director's office. RECORD THE CALL! FYI, You don't need to inform them that they are being recorded. Make sure you get the person's name too.

    Let them give you their final answer and if your not happy, tell them you will take the issue to the media and watchdog....ONLY THEN inform them that you have been recording their call. I'm sure they will crap themselves and resolve the issue ASAP.

    You can record the conversation, without their consent, as long as it is only for your own use and the content isn't going to be shared with a Third Party ?

    So how does it work at the end of the conversation, when you are still unhappy and want to take the matter further ? From the OFCOM link, it looks like you wouldn't be able to use the conversation that you've recorded without their consent.

    Why would they defecate themselves, over something that couldn't be used ?

    I'm confused, could you clarify things for me ?

    So if you took the other posters advice and took the matter to the media watchdog (or is it the media and BBC's Watchdog) , you wouldn't be able to use the recording as it would be against OFCOM/OFTELs rules/guidelines ?

    Well that's how I read it- as they are third parties. In not sure if you can play it to your solicitor- I think you may be able to, but they can not use it in court etc.

    I am awaiting clarification- I don't like being wrong, so I would rather be right next time! :rotfl:

    Apparently you generally need permission to pass it on to a third party, unless they were told upfront. So telling them upfront seems to be the way round the permission.

    Thanks for these replies guys. However, we are not going to take this any further as tbh we're at the end of our tether haha. We have all boycotted this company as from now and will have no other dealings with them. I do believe that because of our ages, we were all 17/18 at the time, they took this is as if they were dealing with little children. I do wonder what the outcome would have been if this happened to lets say a family. However, I can only wonder . I do think we did well to gain this amount , all though measly , it did seem like they were not for cracking !
