If the police decide not to proceed as such but decide they will let your wife off with a caution - you need to know that this will appear on any future CRB/enhanced disclosures.

If they caution yes, it might appear on a check however if they simply drop the case completely then there will be nothing recorded.

Accepting a caution means admitting guilt. The OP's wife would need to be advised by their solicitor before accepting a caution.

Yorkie1, My apologies I did not clarify well, my input was a suggestion to get better legal advice and to not worry too much, a police investigation is not the end of the world and does not mean instant condemnation of his wife!

Having a solicitor with her does not mean she was with great and the best advice, as with the anything it is best to shop around, get as much expert advice as possible.
  • Hi all , it`s been 3 weeks since our visit to the police station due to ex boss trumped up attempted police charge. Still not heard back from police , don`t know if this is normal or if we will hear something eventually Just thought i would let you all know in case you were interested . .

If they were in a hurry do bust your missus they would have done so.

As you never confirmed this was under the computer misuse act, I don't think they would have much of a leg to stand on.

but, with better legal assistance! - Are you in the UK?, The Citizens Advice Bureau are maybe your best option

The op's wife already has the advice of a solicitor, the CAB are rarely if ever a better option than a solicitor, they're staffed by volunteers, students and on the odd occasions former solicitors who are banned from practicing.
