speeding ticket???
Options
hi, today i was slapped with a £60 fine and 3 points! personally i believe on a open road thats a 30 it's ok to do 35-40, obviously my opinion may not be shared by everyone and definatly isn't in the eyes of the law. i have a question regarding what is required if a speed trap is on the road side. i've been informed by a friend that if there is speed trap there shouldf be signs warning you within a certian radius, is this true?
He also mentioned that if there's a speed trap a potrol car should be visable, is this true? the officer that cought me(doing 37 in a 30 grrr!) was stood on his own wearing uniform with no car and a camera sat on the floor 10yards or so from him.
any help would be great.
thank you

You won't stand a chance fighting this in my opinion. No it is not ok to speed in a 30 mph zone. Its there for a reason. Many have tried to fight with such claims as signage etc. Take the fine and learn from it.0

(I ain't a perfect driver) But I see a speeding ticket as being all your fault.
You don't go in to the newsagents and say I don't fancy paying vat on my paper today.
A speeding ticket isn't a 'tax' - it's up to you what speed you do.
Take it on the chin, and be more carefulbaldly going on...0 -
I once got a ticket for doing 34 in a 30 mph zone. Policeman with a hand held speeding camera. I accepted I was fully at fault, as I was doing over 30. I don't see how you can feel hard done by if you know you were travelling more than 10% (for tolerance, maybe) over 30?Debbie0

I thought generally you were allowed 3 mph over the limit plus 10%, that would be what 36 mph? There's some sort of code of practice the police use apparently (I saw it on GMTV once!).
Also I think its only the static ones that are supposed to be fully visible and marked out on the road.
Tough luck mate - I've been there too twice!
If its your first you should be ok re: car insurance but the £60 does smart a bit. BTW don't forget to tell your insurance company.0 -
I've had an SP30 ticket, 3 points and fine for doing 33 in a 30mph zone. I thought it a bit harsh for 3mph, but I paid up without a fuss.0

It's fine to believe that it's OK to break the law as long as you're happy to "do the time" afterwards. If it was "OK to do 35-40" then it would be a 40 limit! Do you really think you're cleverer than the people who set the speed limits? It's like saying "It's OK to drink three pints as it's only a bit over the limit".
The "informed by a friend" is pure "man in the pub" urban legend. You're banged to rights on this one. Whatever you do, don;t go to court and tell them you think it's OK to break the law!
The "37 in a 30" bit reminds me of that advert highlighting the difference between 30 in a 30 and 35. One day you could easily kill somebody that you'd miss if you didn't feel yourself above the law.
Put it another way.
How much time have you saved by doing 35-40 in 30 limits? Don't you just catch up the law-abiding car in front?
What have you done with the time saved? Has it really been worth it?
If the 30 limit is a "bad law", are there others which it's OK to break?
I used to be a worse driver. Luckily I got the correct (IAM) training before I caused any damage. Can I help?0 -
Its a big game and on this occasion you lost, pay the ticket and get on with your life.
There are no requirements the Police have to follow to gather the evidence they need to prosecute, its all urban myth.0 -
The Legal allowance for varying calibration of speedos is 10% + 2mph.
So 35 in a 30, 46 in a 40, 57 in a 50 an so forth.
I wouldnt have accepted a fine and points in 2 of the cases mentioned above especially for the 33mph & 34mph cases!
"i paid up without a fuss"- thats exactly what they are hoping for!!!!0 -

Could you point me in the right direction on the DoT website/literature where this information is published please or provide a reference so I can go and find it? It would be really useful to have it to hand should I ever need to use it in a court of law.
Many thanksGood Enough Club member number 27(2) AND I got me a stalkee!
