paypal. taking money without my consent.

at the beginning of august i sold a festival ticket on ebay. the buyer paid with paypal. he recieved the ticket , went to the festival and left me excellent feedback on ebay a few days later.
in early november i got an email from paypal saying there was a problem with the transaction and that they have taken £152 from my paypal account pending an investigation ( this can take up to 72 days). i supplied paypal with all the relevant details. apparently the buyer has denied recieving the ticket..or something similar.
i have today recieved an email from paypal stating they are taking 148.00 from my bank account to bring my paypal account out of the red. i was in the red due to the money being taken by paypal back in november. i have written to Paypal, and spoken to them on the phone and made it clear they are not to take anything from my account without my authorisation. they have obviously ignored this.
where do i stand legally?
can they take the money from my account without my say so?
what can i do to fight my corner?

    I think they CAN take money from your account without your say so.
    I think when you open an account with them, this is part of their terms+conditions, and is the reason my dad refuses to open an account with them. They can do what the hell they like.

    However, i'd be more interested in fighting it from the perspective of getting your money back due to the fact that the buyer did recieve the tickets and left positive feedback. Have you spoken to ebay? And the buyer?

    but can you prove he got the ticket ie tracking etc?

    You have the buyer's address, right? Pop round and discuss it with them.

    Firstly what sort of claim is it as that makes a difference. If it is an ITem not received claim then you need proof of delivery to the address that PayPal gave you. That would need to be uploaded in the dispute.

    If however it is a fraudulent use of a card or bank claim then you need proof of posting and again you need to have that uploaded in the dispute console.

    Other criteria are required for seller protection, like sending within 7 days etc.

    Might help if you actually read soolins post,there is no mention of ebay in that post at all and the advice given is correct for a Paypal dispute.

    It isnt a Paypal dispute either.

    As a frequent user of ebay and paypal I have always been under the impression that provided you have proof of postage (which is free) then you have fulfilled your role as seller with regards to missing items (unless the postage options specifically noted it would be sent by recorded delivery). If the item goes missing after you posted it, their quarrel lies with royal mail, not you.

    Having also used the paypal dispute centre they seem to be reasonable. Have you contacted them explaining that it is evident the buyer received the tickets due to the positive feedback given?

    I would stop all direct debits that are with your bank and paypal, once stopped in your bank they can not take the money. It is even easier if you bank online.
