Faulty Sat Nav - Section 75 Claim

I had a similar prob a couple of yrs ago with a Garmin, - it wasn't picking up routes, in foreign language, whole saga - been factory reset and did the same, I have a Ford, dad has a vauhxhall, and mine and his sat nat side by side, mine was spot on his dodgy, We ended up getting our local newspaper involved - the consumer department, (can't remember if it was Comet or Currys) there customer service was disgusiting..
As soon as a photo appeared of me holding the Sat Nav with the shop in the background, - we soon got a full refund.
If push comes to shove would you be able to go via financial obsbumen if the credit card company won't play ball. Maybe the threat might be enough to get something done xxx rip dad... we had our ups and downs but we’re always be family xx0 -
Apologies for the delay in replying. Have been away.Just a note, but if the Fords both have the heated windscreen option, they play havoc with satnavs.
Does it work out of the car or maybe in someone else's?
Thanks for the idea. Heated windscreen was definitely off. However the previous TOMTOM had no issues at all in the same car.How much was it? Also if you complain to tomtom again , you may just find they upgrade you like they did with me a few years back

Ouch. Hopefully mine won't be quite as painful. If it is, it will be with either TOMTOM or Halifax directly now that Comet has gone. Hopefully, like you say, the ombudsmen will be able to help if it gets to that point!0 -

Other wise how can you prove breech of contract or missrepresentation.
OP wouldn't need to given its within 6 months of purchase under SOGA burden of proof is on the retailer (or credit card company if held jointly liable due to Section 75) to prove that the fault is due to misuse or similar rather than a manufacturing flaw.0
