washing machine under 6 months old!!!!

  • I know that my neighbours wouldn't mind letting me use their washer if I needed to, but there is no way that I would impose and do this more than once.

    The OP has said that the parts will take up to 10 days (and how many threads have there been where the actual time taken for parts to be delivered was far longer then the initial estimate?), then an appointment will need to be made for the parts to be fitted.

    Their friends or neighbours may not mind someone using their appliance once or twice, but how about if the saga drags on for many weeks, something which is very possible.

    It's irrelevant how long it takes parts to arrive. The law simply says 'significant inconvenience', which is therefore dependent on both the nature of the goods ordered and the circumstances of the customer.

    Personally, I would find being without a washing machine for over a fortnight to be a significant inconvenience, as at that point I would have to find a laundrette or a neighbour who would let us use their machine. I'm fairly sure a court would accept this, and I could demonstrate the inconvenience it caused.

    But you may be expected to do that anyway - since there is a statutory duty to try and mitigate your losses.

    It doesn't matter whether you have people who will let you use their washing machine. It's whether the lack of a washing machine causes the OP significant inconvenience.

    They may live some distance from family. They may work during the day. They may have small children. They may be anti-social and not get on with their neighbours. They may be unable to carry loads of washing across the street. They may just not want to ask.

    Whatever the reasons, if the lack of a washing machine causes them a significant inconvenience then it is incumbent on the retailer to tailor the remedy offered accordingly.

    I don't understand what mitigating losses has to do with getting your washing done. The only issue is the SoGA remedy being offered by the retailer.

    It's what is reasonable I suggest? Most people have friends/family/neighbours/laundry places and can wash clothes by hand. If anyone struggles let them take it to Court for a decision...In reality I suspect the problem will be long sorted long before that happens.

    Again, what people can do isn't what the law is about.

    In the event that the retailer isn't offering a suitable remedy, the OP would be within their rights to purchase an alternative washing machine elsewhere, then separately pursue Currys for a refund of the original.

    Then let them get on with it and pursue it. I'm not sure they'd be successful. Are you?
