blue badges & parking tickets.

Was parked in a spot yesterday which turned out to be a "permit holders only" area. We wasn't aware of this. Yes ignorance isn't an excuse, but not being aware of it is the reason we were parked there.

So for starters, i don't even know whether a blue badge bypasses this or not. If not then there's going to be no joy.

If it does however, then we were dropping someone off at the train station. We took 10-15minutes tops.

Return & the parking ticket is on the floor on the road between the kerb & my drivers door. Open it up & sure enough - it's mine.

That's when we have a look around & spot the small sign on the post saying permit holders only. Gutted.

Thing is, when my mum chucked her badges on the dash, they must've fallen off as they were on the floor when we got back. Again - our/my/her responsibility to make sure they're on display, yes.

Just a question as to whether it's worth an appeal on the blue badge??

For those who are of the stance - no, you were naughty, you should pay the fine, in fact you should pay the fine tenfold you menace to society you!.....

....Her friend has successfully appealed many parking tickets over the blue badge. She often just puts out the timer section & not both sections - so she gets a ticket as per the ruling. She appeals, sends in photocopies of her badges & wins, every time.

So i just wondered if it's worth a punt?

IF so, then i have 14 days in which to pay £35. Beyond this it jumps to £70. If i appeal am i still governed by that 14 day window, or is that put on hold while the appeal is heard?

I think you have posted in the wrong section.
  • They will have photographed your vehicle with no blue badge displayed, you what will your appeal be based on?
  • I would pay up, and be more vigilent next time. That's in no way a pop at you, as we are only humans after all - and all humans make mistakes at some point or another.

By all means try to appeal it. But I would worry about the appeal taking more than 14 days at this time of year, and you could end up paying £70.

No blue badge displayed, so an appeal will not succeed.
The 'parking attendant' cannot be expected to know that you've dropped it on the floor.

As said, my mothers friend is also a blue badge holder & hasn't properly displayed her badge on numerous occasions, receiving tickets ... always appealed, always won.

I agree the attendant can't be expected to know, but what on earth was the ticket doing on the floor/road anyway? Surely you stick it under the wiper to make it as secure as you possibly can.
I know the response ... "but it didn't", however it could've blown all the way down the road, i wouldn't have known anything about it until i received a £70 bill through the door through no fault of my own (yes, the parking was fault, but you know what i mean).

Sounds to me like you've already made up your mind to appeal the ticket and are just looking for moral support.

The 14 days to pay period is suspended for the duration of your appeal. If your appeal is unsuccessful you should still only be required to pay the reduced fee.

You also need to check with the local authority to see if the blue badge can be used in that type of bay. A lot of the London ones have differrent rules as to where you can or can't park.
Also if at a train station is it private property and therefore an "invitation" to pay the PENALTY CHARGE and not in fact a FINE. I believe if it's a penalty charge inform them to contact the driver at the time and not the owner of the vehicle, you do not need to inform them who the driver was
Most London parking enforcement always take photos of the car, signs and the tax disc to make sure they have the correct details...

There are plenty of avenues of appeal. Why not direct the poster to the parking board.

Completely wrong advice and what a shame to just say 'pay up' and then explain wrongly about the 14 day period. If you appeal in the first 14 days then the discount period is almost always RE-OFFERED (bargain, not!!) when they reject. And the appeal procedure - if wanting to win - is a long game not a 14 day rush.

Completely wrong. I have seen loads of appeals like this win.

In fact many Councils have a policy to let disabled people off one error, and cancel the first PCN when quickly appealed in a polite letter/email with a copy of both sides of the Blue Badge.

I popped over here from the parking board when I saw the poster had firstly posted in the wrong place. I am fairly disappointed with the replies this poster got, but not surprised as most people don't bother to appeal at all. Yet it's a fact that most people win in the end if they go through the appeals process to adjudication!

    Here's the right advice given:

Always appeal a Council parking ticket and always ignore a private fake PCN.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
