Can an online shop refuse to give me my money back if it is a pre-order?

Personally I'd skip the Letter Before Action and threaten a charge back via whatever medium you can contact the company.

In the same boat ordered something from him on 4th December still not received my order, also had account deleted when confronting him

I went to my bank and back charged the payment. So hopefully, anytime now, i should get my money back0
