    OK I would like my tm to be 'Poggy' which is a word I decided to call cowsh*t at the age of 3 years, I bet you can't guess what the logo will look like? :)

    Brilliant.

    Sadly, you need to show some evidence of "use". Not sure I want to see / hear the evidence.

    Would a poster in my car window titled Poggy and a picture of said poggy suffice?

    I am hoping to start a consultancy business advising ailing small to medium businesses.

    I'll probably have some farmer from some obscure place suing me because they already use the logo rofl.

    we had the same situation with a company 'disagreeing' to our use of 3 descriptive words in our meta tags and product description, which also happened to be their trading name (they had been trading for 10+ years and we were just a start up). They had the 3 words patented for their industry but what we offer was completely different product/ service - queue lots of letters/ emails back and forth and a lot of 'posturing' about cybersquatting and such like .....

    end result? we still use the phrase in our metas, keywords and text of our website, we also purchased the same domain split up with -'s between the 3 words and theres not a damn thing the company can do about it. lots of posturing and 'bullying' in the online business world and it seems that most of it is people just trying to protect their business, whether they are in the right or not

    you shouldnt have shut down - or maybe just start up again with a tweak or a - or two in the domain just so there is no way the 2 sites can be confused:)

    It is hard to know at this stage what their motive is...they might genuinely be trying to protect the brand image or they might set up keyword searches for all types of trademarks and be going on a fishing trip.

    If it is the former then now you have removed the website they should back off. If the latter then they probably won't bother to chase up too many times...they wouldn't want to go to court and lose a few cases and get a slap for their speculative actions.

    Just let them know you have removed the site (tell them the company is trading at a loss and has no money to continue) and leave it at that. Worst case is they notify you they are actually taking you to court then you can send them a cheque for £500 before the court date.

    There is a good PDF on the IPO website giving examples of what can be trademarked and how trademarks can be enforced but I can't seem to be able to post a link to it.
