  • This is brilliant. I agree with whoever mentioned the press earlier. I think they'd look like complete idiots sending the lawyers after a little guy selling sex toys. There's is no competition or losses here ... anyone that ended up there would more than likely be blushing at their mistake and go straight to the "proper" site.

    crikey a major bed company so desperate for cash to attempt this stupidity which if others suggest made the press would make them look like fools.

    Just ask them for more time to sort things given its the chrimbo period and you need to seek advice.

    One of my old local pubs " The Hobbit " had a similar prob which got massive support and publicity.

    Don't pay anything. You've probably done the right thing shutting the site down, but I doubt they would be able to legally force you to if it went to court. Obviously you can't really afford to do that.

    The question then is what to do next.

    2 options;

    1. Completely ignore the letter / 'fine' they will probably go away now you've shut down the site.

    2. Reply, but don't admit any guilt/liability. Make it clear that you do not have the resources to fight the case (and that if thy pursue you, there isn't any money there to be 'won'). State what reasonable steps you have taken (shut down the site / facebook page as soon as it was bought to your attention). make sure you send the letter to the CEO of silent night and make it clear that if they pursue you then it could have damaging consequences for their brand (you'll go to the media - they'll love the sex toy angle)

    I think the first option is best tbh.
    From feudal serf to spender, this wonderful world of purchase power ;)
