Accident on roundabout

    The very first one as you follow the slip road off - the layout has changed though - so will try for pics myself later

    Thanks jq - that's what worries me, that I pay and then they still contest it via insurance etc or say they were injured

    I probably have to be careful what I write, but thank you for your point re: blame/checking etc

    So I will have a claim unless I'm found to be not at fault at all - but I understand that's very unlikely in roundabout situations, even without taking whatever I say into account. Does that mean I pay my full excess even if its 50/50? And the others would pay their full excess to their insurance company? Seems only winners would be the 2 insurance companies! I can see why it's important to use them because of PI claims etc plus that legally i must tell them anyway

    Can't tell them now as I'm at work but will do later. Other party said they'd contact me with a quote but even of its only say 100 I think it's best to just go through insurance and pay the 300 to avoid issues?

    The only major issue I can see immediately is if you do not report it as an accident to the insurance then you'll have to admit it legally when getting next years insurance won't you?
    The insurance quote will then be affected in any case then.
    Unless specifically stated all posts by me are my own considered opinion.

  • Is this right. You were in lane two ready for exiting the roundabout in lane two. You were within the lane markings for lane two and not changing lanes at point of impact.
    This would point to the other car changing from lane one to lane two therefor putting the other driver at fault.
    I see it often at a roundabout near me. Two lanes on roundabout both marked for same exit ( exit is a dual c with 2 lanes ) lane 2 also marked to continue round the roundabout. Cars in left ( lane 1 ) lane pull out into lane 2 as they exit the roundabout to overtake cars in front and don't see cars in lane 2 correctly taking the same exit.

    That's not quite what the OP said, although it's difficult to make any real sense of his main post

  • I am willing to be corrected on this, but I think the excess only applies to repairs to your own vehicle - third party claims are covered in their entirety.

    Going by the google earth pictures...
    Left lane is left and straight on, Middle lane straight on only,
    Right lane right turn only.

    From your description. You exit the motorway in the right hand lane. My black line. Then you switch lanes to follow the red line.

    If thats the case and unless the road markings have changed then you should have turned right only. From the right lane.

    He was correct in going straight on from the middle lane.

    Is this picture right?

    You crashed somewhere in the orange circle, You changed lanes not them?

    So the issue is with the merge maneuver?

    1) OP was moving from right lane to left lane. Did OP signal, mirror, maneuver?
    If the lanes merge why does OP need to change lanes rather than filter in as the lanes merge?

    2) Was the car that got hit overtaking on the inside lane?

    Sorry, reading it back it was a lot less clear than I'd intended it to be!!

    Went to get some pictures today (my insurers suggestion) and I also got videos of people doing exactly the same as I did.

    I followed it right through from M1 with my pictures - and documented my route. They all show me as being in the correct lane. It was the 2nd roundabout that the incident happened on not the first though

    As the insurance people said, 'moving across' is the wrong phrase to use - the 3 lanes go into 2 due to the hatched areas (as one lane is left only so 'disappears' as the other 2 move across - so I get further away from the centre of the roundabout and it feels like I'm going across, but I did stay in my lane at all times

    Here's a picture - as you can see, traffic light controlled where I was coming from (from right of pic, same as those 2 cars).

    I can't say where the car came from, but I was where the black golf is (right hand lane), as that car flew in front of me.

    The arrow is the 3rd party, in that lane continuing infront of me as if to take the 3rd or 4th exit. Not sure if there was anyone in that left lane next to me at the time trying to go onto the A421 (there usually is), and how they avoided him, but I'm certain he shouldn't have been there.

    From the angle of the impact and way he came across me, I'm fairly sure he wasn't in the lane next to me just looking to change lanes into my lane or continue round - from the damage to his car and the way he appeared infront of me it looks pretty clear he's come directly across - which would indicate it's from where it's a red light.

    Heard nothing from him, although my insurers probably contacted him by now, so maybe he won't send me a quote afterall.

    I'm still confused.

    From your photos it appears that you should not be following the Golf. The Golf is is in lane 2 and you should be going straight on into the newly created lane 3.
