disiplinary hearing againgst me

hi, i was suspended on full pay under allegations of fraudulent dishonest behavior(not stealing money) on sat apr 21st.i am expecting to be sacked as it is my word againgst the companys plus they demanded their locker key back as well.i am gutted as the shop i am working for is due to close on the 28th so i would have received redundancy
i received a letter today saying that i had to attend a meeting on the 28th(my final day of employment)in the letter it stated that if i was unable to get anybody to represent me i had the right to request another meeting within 5 days of the original date.
i just wondered what would happen if i exercised that right and requested a date after my final day with the company.
can they still sack me and take my redundancy away?

any help would be gratefully received!!!!!!

    Hi Mark,

    If they sacked you, regardless of the date, you would not be eligible for the redundancy, as you have not left for reason of being made redundant.

    Could I ask more about the conduct issue? If you are not guilty of the specified act, is it possible to provide proof to this fact? x

    a certain large soft drinks company were recently doing a promotion where if you had a winning code on your bottle you won money for your fav football team.i stupidly undid a few labels and entered these on the computer,
    the company is now saying that somebody complained that their code did not work and they linked it back to me,although i have seen no proof of any complaints!

    That would qualify as gross misconduct I'm afraid, sounds like you are best to be honest, say that you made a mistake, and hope that they will be lenient.

    Had you worked there long? Any previous problems? A good length of service will go a long way to help you.

    i am wondering if there is really any complaints as my manageress actually saw me doing this about seven weeks ago and she actually laughed about it!!!!all of a sudden 7 weeks later they are saying they received this complaint,i think my boss has decided to stitch me up

    The fact that your manageress in effect 'colluded' with you will definitely go in your favour, if you can prove it.

    I would still admit that you did it, but that you did not realise the severity of the offence because of the fact that your manager went along with it.

    The four years should definitely go for you. I would hope that, considering your length of service, they give you a slapped wrist, but it really depends on their motive for doing this.

    Is it a large store that you work for? If so, I am really surprised that they are doing this so close to your redundancy. Seems incredibly petty. A few weeks pay as redundancy money is nothing to them.

    i dont think i will be able to prove my boss went along with it as it will be my word againgst hers and she is very freindly with my area manageress as they are friends out of work(both husbands work in the company bakery as well),
    ,it is a large shop/bakery i work for,sometimes they can be petty.in the month before we received our notices they came out with utter rubbish against two employees who have been with the company longer than me,things they could not prove but i believe they wanted them to walk out and lose their entitlements,but it is ok for 2 other members of staff to come in drunk and get away with it despite the manager knowing about it.
    i think i will follow your advice and come clean and mention my boss knew about it,unfortunatly i dont know if anybody will back me up as they are worried about their money as well

    Sadly I have a friend who has been through the same thing with your company (albeit many years ago).

    They are a petty company, plenty of nepotism, and penny pinching to the max.

    Let me know what happens in the disciplinary. If they do terminate your employment, then appeal it. I don't think that you will get far (though I hope I am wrong!), but the way I see it is, with a company this petty, I would do my best to cost them as much in man hours as they would have paid you in redundancy. I know that is being as petty as them, but it will hopefully make you feel a lot better! x
