PPI Breat Implant Replacement

Hi, I wondered if anyone could give me their opinion on this...
Firstly I've just noticed I put PPI implants not PIP lol can't find how to change that but anyhoo........
I had breast implants in Feb 2006 at a well respected hospital in Hertfordshire. I paid close to £5000 instead of the £3500 I could have paid at a 'clinic' advertised in glossy mags as I respected the scale of the operation and figured you can't put a value on your health!
In Jan 2012 I received a letter from the hospital saying that for a short while they used PIP implants and I fall into that time frame. The letter stated that they would scan me and then either review them yearly or I could just opt to have them out straight away.
I was obviously very pleased that they were offering to help as the media was full of so many horror stories, however I was 9 weeks pregnant so not in a position to do anything. I called them the same day and advised what was going on, they told me to call after the baby was born and wished me luck
I then received a letter thanking me for attentding a consultation with my surgeon and confirming my date of surgery for May 2012, they even included dinner menu choices! My baby wasn't due until August so I called them and let them know there had been an error. Then I received a further couple of phone calls over the next few weeks urging me to book in to see the surgeon, I kept reminding them that I was pregnant only two find there were two hospital branches dealing with it as the surgeon has relocated since my op and they weren't sharing information. I was told to deal with a lady called Jane at his new hospital.
I spoke to Jane in October once I had finished breast feeding and she sent me to see the surgeon who in turn referred me for an ultra sound. He said call Jane as soon as you come out. Which I did, she then said right lets get you booked in for 2 weeks time. I agreed but after 10 days of not hearing from her I called to see what was going on only for her to tell me that they were running special clinics for these cases and that they weren't confirming surgery days until all the slots could be filled and that had been going on the whole time I was pregnant and that now there is only myself and one other girl left so we weren't a priority. I had a polite but firm rant at her saying I needed this done during my maternity leave as I return to work at the end of Jan and she said she would try to sort something out.
I didn't hear anything for ages, chased her up, was promised a call which never came and unfortunatley then had a kitchen delivered by The Kitchen Factory (see other threads!!) which distracted me for a while!
Last week I received a call from the original hospital saying that they had a surgery date for me which is the 12th of Jan. The problem I have is in mid Jan my partner is going to have major surgery on his ankle, he has been on the NHS waiting list for months so we cannot cancel but it is far from ideal for us both to be out of action at the same time when we have a 5 month old baby!
I explained this to the lady I spoke to who replied that the company are 'tightening up' on the expenditure on these cases, that this is the last surgery date and the best one was that if I don't have mine the other lady who is waiting can't have hers!
Can they treat me like this? It's not my fault they used a below par product and charged top money for the procedure and to be honest the way its been handled sticks in my throat.
Are they within their rights to dictate to me like this, should I fight back or just take the offer of the operation FOC in case I lose my window of ooportunity? I would like to add that I am not having them redone out of vanity, it's purely because I would rather not have a bit of matress in my bra lol!

i am not sure of the legal situation here - it was a tricky one from the start with lots of experts on TV and in the media discussing this. Not sure how far they got. Sounds like you were "lucky" if that is the word to use, that the hospital and surgeon you used faced up to their responsibilities and have worked to sort this out.
It sounds like they did not undertake too many - although of course who knows and that they have been rectifying the situation over the last year. This has probably been funded by the hospital itself. I imagine they now feel that they have faced up well to their responsibilties and that it cannot go on for ever.
To a degree I appreciate what you are saying, but they have been trying to sort this out for you for a year now and it is not really their fault that the date they have offered (which is within the timescale that you specified) is now not convenient. I can see their point in having to schedule these surgeries on the same list - although I am sure it is not imperative. To be truthful if it was me and I wanted the surgery I would go ahead - the potential for problems and delays if this surgery is cancelled is something I would not want to get involved with.
Your husband's surgery - can you not call and ask to change the date by a couple or three weeks - can you discuss it with the booking officer to see if they can assist with this. Just because it is NHS does not mean it cannot be changed.
I hope you can get this sorted out. I actually think they have handled it pretty well by taking responsibility and sorting out a remedy FOC.0 -
Hi with regard to the hospital offering to re-do your implants, I would be keen for any help I can get please:
I too went to one of the leading private hospitals when diagnosed with breast cancer, who told me the implanats would last up to 20 years. After 5 years the shape totally changed and the consultant told me they needed changing and not say why, I was just so shocked they needed replacing after such a short time, I tried to speak to communicate with the consultant via email and he never replied, the hospital told me I have a claim with the surgeon, I told them we paid the hospital using our joint credit card. We could not afford for me to go private again, I waited 6 months for NHS. I dad the op and learned the reason for the deflation was because the filling tube had been left in thus the implants - deflated. Have been in touch with the bank Ombusman who claim because they were replaced on NHS I cannot get a refund! You may have a claim against the surgeon for negligence, however this could take years to settle. You would need to speak to a specialist solicitor about this.
The Ombudsman is correct to an extent, as the aim of compensation is to put you in the position you were in had a breach not happened. In this case, the NHS has done that - or are you wanting to claim so you can pay them back?0 -

Then click on Go Advanced.
Type what you like in the Title: box.
As well as getting the IPP letters in the right order, you might want to add an 'S' in the second word.0 -
I used to work in a PPI (Payment Protection Insurance) department for a large bank and we received a letter from a woman once asking for a refund on her PPI breast implants. Had NO idea what to do with that letter. Hope you work out a better route to take than she did!0

You send it to the department that deals with S75 claims.....Never ASSUME anything its makes a>>> A55 of U & ME <<<0
