Don't pay them to fix it. Take it back, point out you've had it just over a year (don't mention warranties), and that it should not have had such a catastrophic failure within a year. You should expect free repair or replacement with a similar or better product. Let's start from there and see what Currys come back with...0

The issue is still ongoing.
Unfortunately i just didn't have the time to take it back to PC world/Currys
I've only just got round to having the money to spend to take it to a pc repair place and after stripping it down they have told me it needs a completely new motherboard at a cost of £196 +VAT :eek:
Well i'm not paying that.
Seeing as i have waiting so long (due to funds and other issues going on when 'life' just gets in the way) would i have any re-course or should i just resign myself to the fact that it's gone?DEBT FREE AND PROUD'Better to remain silent and be thought a fool than to speak out and remove all doubt'0 -

As its been over a year theres not much you can do, you could always get a second quote. How was it purchased ?

I haven't got the laptop in my possession as it's still 'in for repair'.

Sale of Goods Act does apply here. If the fault is inherent (i.e not caused by fair wear and tear or misuse, but by a manufacturing fault or otherwise not being fit for purpose) then the retailer has to repair, replace or refund. The refund can be partial to account for usage. You cant force them to choose a remedy that is more expensive than one of the others, so technically they get to pick the remedy.
However since it is more than 6 months since purchase then you may have to prove the fault is inherent with an independent report because after 6 months it will be assumed that no faults are inherent.
It's also complicated by the fact you have sat on the problem for a year. If you can prove it broke a year ago then they should treat it as a one year old laptop (the age it was when it broke), otherwise they will assume it was working for the last year and you have a two year old broken laptop.
The older the laptop is the less value it has, up to the point where it has lasted a reasonable time and they no linger have to fix it.0 -

If you've sent it for repair you can't retrospectively claim under the sale of goods act. Do you mean its still with the engineer that said it needs a new motherboard, or that you agreed to have it repaired?0 -
Hi Mike, it's still awaiting collection as i'm not paying that much to have it fixed as it's not worth it. What i might do when i collect is aask him to write on my invoice that the motherboard is fooked then take back to Currys/pc world and see what they say...DEBT FREE AND PROUD'Better to remain silent and be thought a fool than to speak out and remove all doubt'0
