  • We flew to San Paolo and on the way back the plane had technical problems so it was transferred to air France and hence the massive down grade :( interested about the 75% downgrade rule do you know where that is written down? we already got our air-miles back so it's just the taxes sorry original quote was vague

Article 10 here - http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:32004R0261:EN:HTML:NOT (I'm on my phone hope the link is ok).

However, if they've refunded your miles they may view that as case closed. You may have to take things further.

Have you written to BA - rerouting F passengers in economy seems very strange. What options were presented?

As does putting them on a non OW carrier.

Again OP, we need more information, did you choose to fly with AF rather than waiting for BA, did BA charter an AF plane etc? Could you give us the date of travel please, then we can look into this further?
  • We had two choices wait 14 hours at an airport hotel.

Or get on a air france plane scheduled in 2 hours,

    Here is all the details,
    Case Reference: 10416721

    To whom it may concern

I am writing to make you aware of a recent flight experience that did not fulfil our expectations. I booked for myself & my wife return first class flights to Sao Paulo, Brazil -booking reference is 8MGKGL.

Our return flight from Sao Paulo was delayed by 10hrs due to technical problems and we were transported home by Air France in economy seats. As I am sure you can imagine, this experience, was not what we had paid for and not how we had envisaged ending our holiday.

Total Expenditure (Man to GRU/GRU to MAN)

    • 360,000 Avios
    • £1183 (Taxes & Charges)

Therefore the return journey for my wife and I cost us half these amounts.

Return Flight Costings (GRU to MAN)

    180,000 Avios
    • £591.50 (Taxes & Charges)

I am aware that there will have been an expense associated with transporting us back payable to Air France. However after speaking to Gardip, at BA customer services, on Friday 26th October at 12.30pm who created the reference log, I am not fully satisfied with how we have been recompensed or that it is appropriate to our experience.

    We have been offered
    • 55,961 Avios
    • 30,000 ex gratia payment each to maintain our goodwill
    • No confirmation on refund of taxes & charges
I am looking for re-numeration that would take my wife & I back to neutral ground where we would effectively have paid for flight class we travelled in.

I look forward to hearing from you within the next few days & would appreciate confirmation either by phone (***********************) or e-mail (***********************) that you have received this letter & are giving it your upmost attention.

    Kind regards

Given the choice of 14 hours in a hotel then F on BA or an economy flight on AF, I would have taken the hotel in a heartbeat.

So you were offered 2 choices to resolve the situation. You chose.

    Is there something I'm missing?

Whist the calculation of miles will be the same for both outwards and return will be the same in both directions this is most definitely not the case for taxes. The taxes ex UK are much higher than the return

BA shows GRU-MAN one way in economy 30,000 miles and £191.71 taxes and fees each
and in First 90,000 miles and £249.11 each

so had you booked economy with BA for your return you would have spent 60,000 ,miles and £57.50 less for each person

I am going to join the band of those who would certainly have waited for the delayed F seat rather than be moved over to AF in Y. This was a choice you made for whatever reason

Probably the experience of ever turning left as you enter an aircraft.

Regardless of them "making the choice", surely the EU regulations still stand. The EU regulation someone quoted says "75% of the price of the ticket". I assume that only covers the leg that was downgraded, so it would be 135k Avios (plus the 60k "goodwill" should they still choose to) and £377.90 back from the taxes and charges. In fact, I'd personally push for more considering the rules state it must be paid within 7 days and (presumably) it has now gone past that.

Unless they were explicitly told that they would be waiving their right to EU compensation should they choose the Air France flight (though are they even allowed to do that?).
