House in trust, new partner moved in with step Mother - UPDATE bottom pg 2 help?

    Thankyou for your reply Land Registry representative, I will have to check when I get home tonight.
    It does seem a bit strange that as you and your sister are adults you were never shown your father's will. I had a step-mother who seemed very honest but we found out after she died that she had taken money from their joint savings without my fathers knowledge, obviously it belong to both of them and she was entitled to share it, but to do so behind his back without telling him was very distressing for him.

    Hmm I didnt know it quite quite common practice for everyone to see the will. I thought it was prob quite straight forward so we didnt really need to be shown, and we never asked to see. Is it normal for the will to be passed around the family to ensure everyone sees it? Its the first death in my family since I was about 12.

    it is not common practice but if your were benficiaries of the will, the executor should have been in touch.

    In one case I know two children were told exactly the same; when step-mum died they discovered that she had left everything to recent friends and had never even executed the will.

    I assume the executor was my step mother, we havent ever seen anything in writing, is it likely she would be the sole executor or would there have been others? Should the executor have given us something in writing?

    If it is all above board you need to know what is due and under what circumstances and who any trustees are.

    Yes, tbh I wouldnt want my SM to know anyway, because digging around still feels a bit disloyal, and I wouldnt want to give her the wrong impression.

    I have printed off the application for probate search and have filled it out ready to send later. I agree its time we shed some light on it all.

    OP do you even see your step mum any more? I only ask because you mentioned that you had never met her new partner who she now lives with and it seems to me that you might be walking on egg shells for nothing. A 50% share of a house is a lot to think about and you want to make sure you protect your inheritance, are you sure you even have a share rather than your step mum just placating you at the time of your fathers death?

    Before you do anything else, order a copy of the will from the Probate Service.

    Then and only then will you be able to determine what should have happened.

    You can then take it from there - eg by registering a charge over the property if necessary.
