    Ok Claret_Mike, I got ya and yes I agree that perhaps it would be viewed as mis-representation rather than mis-selling... but my opinion on outcome is the same regardless

    Ah, may be I mis-read it Jim: "Appeal / Application:" I took as being the trial which will decide upon their right to be granted Leave to Appeal.

    Anyone know whether this is the actual Appeal trial or the request to Appeal?

  • Does anyone here have enough legal knowledge to explain the implications of being granted leave to appeal? Does it mean that there is a valid point(s) of law for assessment, or is it merely granted in the interest of fair justice?

    I found this on Yahoo Q&A. Not sure if it's helpful !

    Leave to Appeal is simply 'permission to appeal' to a higher judicial authority

    It can be granted by the lower court (say the county court) to the Court of Appeal; or from the district judge to the circuit judge.

    If permission is not granted by the lower court, you can apply for permission (leave) directly to the higher court which may then hear the appeal.

    The test for permission is "does the appeal have reasonable prospects of success". Unsurprisingly it is difficult to get permission from the lower court, whose decision you are challenging.

    UGGH - They've got something up their ugly legal sleeves.

    Something thar irritates me immensely is their comment that we have not been financially compromised, errm did that not apply to the <25k fraternity?
