Data roaming charges abroad

Hi I have just received my monthly bill from three with a charge for data roaming of £19.99. Not a lot but i was in Malaysia where I was unable to get a signal let alone use the phone. I contacted them and they said my phone was set up for data roaming at the start of my contract and yet if i log on to the website MY ACCOUNT states I am not set up. It also states you have to contact them to set it up. They refuse to refund the money but have given me £5.00 credit for my trouble.
Anyone had the same problem or any advice please.
Also my phone is a Iphone 4S which I know has had some issues. Could this be one of them?

    Clearly you had data roaming switched on? The fact your account shows it not set up is fine when you are in the UK, but abroad? The roamed network has no idea what you have signed up for, so those charges will be for the multiple attempts your phone made to establish a data path - and this network billed 3UK for the traffic, even though you were ultimately unsuccessful.

    Only if you had data roaming turned off by default could you argue he charge was unfair.

    If data roaming is disabled on '3' side even mighty data-hungry iPhone cannot overcome this.
    If it really is disabled and you didn't contact them to enable it, follow their complaints procedure and demand the refund.

    None of this is true. If the service was denied and wasn't provided, Three cannot charge for it.
