    Yeah I know but it has to be one of the crappiest rules of DSR in my opinion. Although I disagree the timing of return indicates what you are returning under - I think you should most definitely have to jump through hoops for returning something (by the OP's own admission) they screwed up when ordering.

    I'd hate to be a business owner!

    As a business owner they must include the risk of items being returned by DSR when they are pricing their items in the same way a physical shop has to factor in costs for running the store. It is like any other potential overhead.

    To be honest, i think that the DSR's help encourage online shopping by removing risk for the customer, and therefore while there will be times the company are out of money for returns, they are helped by the increased amount of customers who are buying.

    OP - did you contact SD regarding the return prior to sending back the item? (Email or their web-form is OK).

    If yes then you have complied with DSR requirements.

    If no, did the item physically arrive back to SD (recorded delivery tracker should confirm) within 8 working days of you first receiving it? (7 working days beginning the day AFTER delivery). If yes then you have complied with DSR requirements.

    If no then you are subject to their own T&Cs and probably have to suck it up.

    I agree that is true, however, what happens if the company do not receive them back within 7 days and there has not been any written contact to advise of the intent to return?

    Doesn't matter. DSRs take it from the day it was sent/posted. Not the day it was received. Nor do they have to specifically state they are cancelling under DSRs. The only requirements is basically that it is done in a durable form and that its clear their intention is to cancel.
    (b)sends it by post to the address last known to the consumer and addressed to the supplier or other person by name (in which case, it is to be taken to have been given on the day on which it was posted);

    Only legitimate reason they may have for withholding outbound delivery cost is if perhaps it was next day delivery or something that isnt standard delivery......OP?
