Napier Parking new trick?

I've got a legal action letter from Napier Parking.:j

This is a new one on me.;)

They've included a court transcript from Milton Keynes County Court reference 1MK02144, a Napier Parking LTD v Mr Darren Yau civil case.

Quite interesting reading. But then I like fiction.:p

Are they allowed to use transcripts from court cases, as yet I am waiting to hear if this is a genuine case? If not, someone is going to get a copy of this letter at MK court. :D

If it is genuine. Wooooooo they've won ONE case lol :eek:

So who wants a copy for a laugh?

    The interesting thing in this judgement is the District Judge actually stated in his summary of facts "The records show, and I find, that the penalty notice was printed at 14.12, so 14 minutes afterwards."

    Now I thought that the perceived wisdom on here was that PPCs were not allowed to issue penalties? I happen to live quite near this lake and it is a large public lake with windsurfing, a hotel, gym, kids area etc. If you don't have change, there is one cafe which is a good couple of minutes from the nearest parking, or the hotel bar. Neither can be reached within 2 minutes - the grace period.

    The area used to be free parking till some years ago and is quite a cash cow for the unwary.

    But how could the judge value the loss at £80????

    Yes this is a genuine example of a rare court win by a PPC.

    It was a classic case of a not-very-clued-up defendant going in with a rubbish defence - he basically claimed that a) it took him a long time to get to the P&D machine due to problems with his daughter; and b) the signs were not prominently displayed.

    All of which was dismissed by the Judge, who also ruled that Napier's £80 was a genuine pre-estimate of loss, and not a penalty. Although how Napier could have lost £80 because somebody took 15 mins to buy a ticket is not explained. Unfortunately, you can get bizarre outcomes like this in county courts.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Am I missing something here?

    The front page says "Monday 13th April 2012" but 13 April 2012 was a Friday. Probably not important, but confusing all the same, so I am happy to be corrected.

    I think you should pay up with monopoly money :D:money:
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    Napier are one of the very few PPC's who actually own the car parks they operate in or in the case of Willen Lake, are properly contracted. Napier Parking is run by the de Savary family as is the Willen Lake car park and the centre there. The lake may have public access but the car park and and centre are privately owned/leased.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(
