Northern Parking Services notice

Hi,

I received a parking notice outside of a hotel in newcastle on Sunday. I was in the car at the time and was told I was caught on camera (8 minutes!).

Incredibly annoying as there were two spaces free next to me and I was in the car the whole time!

Can anyone suggest what to do with this particular company? I have seen the general recommendation is to ignore.
However I was parked in the wrong place with signage right in front of me and I REALLY dont want to pay more than the £60 early charge.

Do I have a leg to stand on?

    1) Pay
    2) Ignore
    3) Appeal, get a popla number and appeal and then ignore.

    1 is a general no no.
    2 is the best option
    3 is for those that want some fun.

    If so, if you'd parked there prior to 1st Oct you'd have been clamped within seconds - a notorious space apparently.

    Anyway, I digress. Regardless of whether it is or isn't, you need to know that the legal remedy for trespass is damages caused. Unless your car caused the landowner actual financial loss, then you legally owe them nothing at all, regardless of what it might say on a sign.

    Provided it's not a hire or lease car, and you know the Registered Keeper (they are the ones that will recieve the meaningless threats) you can either (a) ignore everything (eventually they will give up and go away) or (b) appeal to them, then appeal to POPLA (the independent appeals process) and THEN ignore everything.

    Option (b) will cause the parking company to incur some costs, but is not binding on you regardless of the outcome of the appeals.

    If I do ignore, what's the likelihood of court action? Does anyone have experience with NPS in particular?
    Also, is there any chance of them sending bailiffs round?

    Court? None. Bailiffs? None. Any way, they can't send bailiffs to your home. A court would have to appoint bailiffs if the PPC took it to court(they won't), they won(they wouldn't), then you didnt pay(you probably would pay). The likelyhood of this is as likely as me winning the lottery every week next year. Miniscule.

    PS I never play the lottery.

    Given that its Trespass, I'd love to see them try court action - they'd be locked up for contempt!
