Better model supplied - now shop wants it back

Hi all,
I bought an Xbox bundle from Argos last week and put it away for the kids Christmas. When I went into Argos today an assistant told me that they had given me the wrong Xbox bundle by mistake. They'd given me one that was £120 more expensive and wanted me to return it so they can replace it with the cheaper one. I'm back home and have checked and they have given me the more expensive one but a stock check shows no Xbox bundle like the one I was supposed to get in the whole of Scotland. I don't want my sons Christmas ruined with no Xbox so where do I stand?

How did they know you bought an xbox last week ? or what prompted them to tell you ?

Assuming the receipt shows the correct bundle, the store will still have that one in stock - it will have deducted it from the stock count, but as you did not take it will still be there waiting for you.

Seems a no brainer to me - do the right thing. Someone could lose their job if you do not.
  • I went in to buy something today and they recognised me. I didn't mention anything.
  • If you have paid and been given a better one then as long as they meet a reasonable cost for you to bring it back then return it.

Someones job could be on the line because of this...

'I've been home and checked and it looks like you've given me the correct item.'...

Depends how moral you are I guess.
  • I haven't been in Argos for awhile, but don't they check the item on collection from the counter.

They sold you the item at price X and then gave you the product you paid for, checking off the item when you collected it.
Power is good, but then you get the bill....

Once you have left the store, then the item is yours! There is NO obligation to return it.

No way, if they had not known you or you had not gone into the store ever again how the heck would they have got you to give it back. It's not as if you stole it-you paid for goods you were given goods and took them away. I can guarantee you they wouldn't be bothered if they had given you a cheaper bundle instead.
  • Depends on morals - it could easily cost someone their job but I don't think there is any legal obligation to take it back.

I doubt it will be at the cost of someone's job.
Mistakes happen & it would be hard to say who's it was.

They made a mistake, what are they going to do to erctify it and compensate you for your extra journeys etc?

If you do decide to take it back, do not under any circumstances do so unless they have your original one for you and check it before you leave the store.

Or just do as Arcon5 suggests - they can do nowt about it.
