Third party insurance/lawyers not responding to request r.e incident

I've recently had an car incident, where a drive slammed in left hand side passenger door on a roundabout by coming into me in the middle lane, from the left lane.

My insurance company who have instructed an independent company to fight my case and told the third party insurance/lawyers that they rubbish the claims the accident was my fault and the TP is completely to blame for this accident.

The other party/insurance/lawyers have yet to get back to my lawyers and to the independent company my insurance have instructed to act on behalf of my case.

My question is, is this a good thing? How long can it go on before they have to respond?

I have a witness who confirms I did not cause the accident and TP rammed into my passenger door by trying to take the third/4th exit by coming from the left lane into the middle lane.

    How long do your people say it should take and how long have they given them to respond?
  • Who is the witness? Someone in your vehicle or an independent person who saw it?

    Roundabouts are always difficult to manage and frequently ended as 50/50 unless there are indep witnesses. How long it takes to resolve depends on how quickly each party responds, how much they do by phone -v- snail mail etc but disputed liability cases tend to be measured in months rather than days

    If TP and/or their insurance admit at fault, it will be resolved within a matter of weeks, but it can take another 8 months and even more to resolve as the third party don't have a requirement to respond within a specific timeframe.

    Completely independent witness, they were in their own car, behind TP and seen it all.

    What makes me mad, even though it wasn't my fault, i wasn't going to claim for such a small accident that would of cost £100 to fix at a backstreet garage.

    but, now they've played the injury claim game, and saying they've got pain here, there and everywhere. Which has made me furious.

    Yes and you won't get a full settlement til you are fully recovered from your fictitious injuries.

    £100 is a smart repair so I don't see how you sustained any injury.
