My comments will not be what you want to hear - but FIL's wife is FIL's next of kin and there is probably not much you can do about the possible inheritance problem. At this stage its not your Husbands money, it still belongs to your FIL and the step mother will presumably get first call on the cash etc if no will has been made unless your Husband is a 'dependent' (which is unlikely). If your FIL has made a will leaving it all to step mum, then that is his choice. I guess the step mum is the one who needs power of attourney too - you and your husband taking over is probably a non starter. And if FIL is still relatively compos mentis I guess he does have a lot of say in what happens.
Smeone with legal training may be able to offer more welcome advice but , personally, I doubt you've got a leg to stand on.ELITE 5:2
