I have a date for going to court. What happens now ?

  • the initial court was northampton....if you claimed online...mine was. But once rejected I got a letter from them saying it will be dealt with by local court. Wolverhampton court sent details this morning with the AQ so it will be held locally...as will yours be I would have thought. From what Ive read though, everyone gets settled at the 11th hour before going to court...or they simply dont show up and you win by default

  • I had similar response from my court notice that HSBC's solicitor (located in Birmingham) will defend all of the claim, but also this week offer arrived from bank made without prejudice, which only covered charges not interest or additional court fees.

    Hopefully the Birmingham solicitors response is standard that they intend to defend, and most HSBC customers receive offer? prior which they accept or continue to court and the solicitor does a NO show??
    Like everyone else worried I'll be first to get turned down if I continue

    Hopefully a previous HSBC claimant will shed more light on banks Solicitor's likely course of action???

    Keep the faith, I am in the same position for my daughters claim, but back down now and you lose it all. I will keep my fingers crossed for you. Gook luck.

    Sorry forgot to say my daughters case is HSBC as well. With DG Solicitors, in Birmingham defending the bank. their defence is five fold and is full of legal talk but i will sit down and try to break down into laymans terms what it all means. One thing for sure we will go to court.

  • It was great to receive some feedback, I'll be taking all the comments on board. I think I may need to contact the court or go on line and see about switching the hearing, really don't want to be travelling all the way to Northampton. It is good to know that HSBC may be deploying bog standard tactics and although I won't deny I am nervous I intend seeing it through to the end. Anybody know that if an offer has been made "without prejudice" whether this carries any weight in court or does the "without prejudice" mean that the court should not draw inference from it. It is hardly likely that I am going to receive a copy of the offer letter that HSBC say they sent in any event so I am goint to be operating in the dark on the day on that one. Would HSBC have to file any documents with the court in this respect. All tips and guidance gratefully received from now on in!
  • I've been fighting Barclays since November last year for about £1700 and they've been obstructive throughout. I made my claim through the link to Moneyclaim site and it went to court. Barclays defended it and I had to pay a further court fee of £100 (on top of the £130 to make the initial claim).

    I received notification of the court hearing today and it's on 28th August. Don't mind admitting I am VERY nervous about it. I'm also on holiday 7-16th August and am frightened this will cause problems.

    What do I do now? I have to submit my documents by 14th August - I take it this is the Court Bundle. I've looked at a link on another site about what this is but it seems like a load of unrelated gobbledigook that doesn't make sense to me AT ALL. Is this usual court/legal speak?! Can anyone explain it to me in words of no more than one syllable?

    DO I also ring or write to Barclays litigation dept MOnday to see if they might now settle before I go on hol? or does this seem too 'desperate'? I'm so nervous that I'll be the one that the courts finally rule against and end up with nothing!! HELP!:eek:
  • i was given a court date today for the 21st september as abbey are defending! it says?:

    'each part shall deliver to every other party and to the court office copies of all the documents (including any experts report) on which he intends to rely at the hearing no later than 14 days before this hearing. the original documents shall be bought to the hearing'

    what does this mean? do i have to send them everything? or just bring it with me?
    and are they likely to pay out before the court date?
    and is there a letter i can write to them to 'suggest' settling before court?
    please help anyone as i didnt think it would go this far!!

    I am the same as you on the 20th sept. I got a number today for the solicitors they are dealing with and was going to phone and try and get payment earlier. The number is 0207 7564398 is ronan or claire. Hope this helps and good luck with it all. You have to get 3 court bundles together sure if you can look on this website you will find more info.
