    OK. After recalculations that brings our exp down to £1941.75 which leaves us with £450 per month (for now) to pay the IVA, nowhere near their £685+

    Do you mean include another SOA with our papers when we submit them or post one on the site?

    We will be £1267 per month down. Obviously car fuel costs will drop but then other costs will go up.

    Do you think the judge will look favourably on us as we have tried t sort things out by going down the IVA route but it just hasn't worked.

    As far as I can see it is one of two options:

    Pay an IVA with all your disposable income (and then some) for 5 Years.
    Go BR and pay an IPA for between 50-70% of your real disposable income for 3 Years.

    As painful as it may be, I think BR is the best choice. And from the figures you give I think the judge would not bat an eyelid.

    BTW the OR will gladly review any I&E/IPA when they baby comes....

    I mean include the 'future' income and expenditure with your petition papers...they have extra space to put additonal/important information...and the birth of your baby and the effect this will have on your income and expenditure is pretty crucial stuff.

    In my BR experience the Judge didn't 'judge', he asked what advice I had taken leading up to the bankruptcy and I explained what avenues I had explored. He was perfectly happy with that. I don't think you really earn brownie points in this game. I believe it's the OR who asks the most pertinent questions.

    Yes. But I wouldn't stress to much. Essentially the judge is asking you affirm that you cannot pay your debts, and that you have taken advice that BR is the best option. Normally that is sufficient to get their signature/stamp/whatever.

    After that the OR deals with all practical matters.

    Fermi. Are you saying we can apply for BR regardless but the OR will decide whether we have to go for IPA or BR?

    I have to go now as dinner is ready and the OH can't understand why I spend all my free time asking my computer questions about BR (bless her)

    Any other comments on this thread will be greatly received.

    I'm saying that from the figures you give, I can't see why you cannot go BR. But you should take some professional advice from somewhere like CCCS or CAB.
    We can give general advice on a forum like this, but in the end you must seek professional advice to ensure that you make the right choice for you and your future.

    With regards to the judge, they will generally not go through your form with a fine tooth comb, since they don't have the time. They depend upon the OR picking anything up later, who could apply to annul your BR later if they considered it not to be justified.

    Again, if you are not sure then get some professional advice.

    So I'm filling the papers out now. Section 11, the bit where you have to pour your heart out. How much detail has to go into this. Can i give bullet points i.e.
    * Partner left abusive relastionship.
    * moved from renting 1 room to renting flat
    * got bank loan Blah blah blah

    Or do I have to make the while thing more human. Also how far back do I have to go? I mean I started having problems back in 2001/2 and just kept living on credit? If i have to back that far, well It'll be a novel i can tell you!!!!
