Hi
I have just received a letter from American Express telling me that I am not entitled to a claim.
The letter states:
"You enrolled in the American Express Repayment Protection Plans online at the time of your American Express Card applications. Our records show you answered ‘yes’ to the relevant questions requesting the cover and you confirmed to us you were eligible for enrollment in accordance with the Terms and Conditions of Membership at those times.
I am sorry you feel the American Express Repayment Protection Plan is unsuitable for your needs. American Express does not make personal recommendations to customers regarding the American Express Repayment Protection. We provide you with sufficient
information to make an informed decision as to whether the American Express Repayment Protection Plan is appropriate for you. This is detailed in the Terms of Business Letters we sent with the full Terms and Conditions of Membership we provided after you enrolled. At these times you were given a 30 day period in which to review the suitability of the policies.
We believe our Cardmembers are best placed to assess their personal circumstances for themselves.
We consider the American Express Repayment Protection Plans were provided to you on a fair and reasonable basis. The Terms and Conditions of Membership were part of the applications you signed and confirmed your eligibility at those times. You therefore had
Policies which would provide financial support subject to those Terms and Conditions of Membership available to you at those points of sale.
On this basis I have been unable to uphold your complaints."

Some references for you !
I have 2 cards, one taken out 2005 and the other 2006
Both done online.
I have an email from the 2005 card still in my inbox. In this email they sent me a form to sign back and return. and some T & C
"Amex Signed Agreements 2005a" & "Blue Generic Sign T's & C's"
I have read through these 2 T and Cs and there is no mention of Payment Protection ! I will upload these if any of you want to read them, but I cant find any mention of PPI !
Is this standard?
Do I have a possibility of a claim?
Thank You

Your PPI will have shown in each monthly bill. If it didn't show, then you didn't pay any. Saying you have an E-Mail which doesn't mention PPI is not evidence that it was not detailed in the Terms of Business Letters you were sent with the full Terms and Conditions of Membership.0 -
I agree with Moneyineptitude, you chose to take it out, they didnt actually sell it to you.
End of the line I'm afraid..............make the most of it, we are only here for the weekend.
and we will never, ever return.0 -

You've already complained and had it rejected.

Unfortunately, you don't have a valid mis-selling complaint.0 -
Hi, Thanks for your feedback, here is a few of the reasons I believe I was missold the PPI policy
1) Terms and conditions were not clearly marked on the online form that I filled out back in 2005.
2) T & Cs and T& C with my signature that I sent back to Amex did not make any mention of PPI See attached Exhibit AB2 Blue Customer Copy T's & C's) & (Exhibit AB3 Blue Generic Sign T's & C's)
3) I was under the impression from the way the Online form was presented that if I did not take out the PPI I would not be offered the Credit Card.
4) I never thought that I might find it difficult keeping up payments, since I was in full time employment and healthy.
5) The cost of the policy at £X was unusually high.
6) From February 2008 to October 2008 I was self employed
7) When I made the application for card ending 4005 online there was an opportunity for me to review the information before it was submitted, I copied and pasted what I saw in the screen at that time and saved it as an image file.
I was under the impression after reviewing the application I had just received that the cost of the policy was only £15 a year, since It stated on the form “£15 1 year single policy”
This is not the price of the policy, so what was stated next to the box I ticked was misleading.
I was led to believe it was only £15 a year when in fact it was a percentage of my monthly balance !
What do you guys think?

The image is just the following:Credit Card Repayments Cover:Yes
Card Protection Insurance: £15 1 year Single Policy
I copied the above from my original online application.
I have it saved from 2005 !0 -

Thanks
Send all your "evidence" to FOS, it's the next complaint stage.
Do be aware that this can take up to eighteen months and that the Ombudsman will side with the Bank in cases were PPI was bought rather than sold.
