MBNA Claim Upheld Now What

    When you got your letter from FOS confirming they are upholding in your favour did it include any figures of the redress you are likely to expect?

    No. It just laid out the reasons why it was upheld and specified the timescales which MBNA would have to respond.

    It also included a copy of the letter they sent to MBNA which sets out their options so everyone knows where they are in the process. The FOS don't seem to take much notice of MBNA's lack of response.

    Yes this is the response I recieved last June, I have pestered the FOS since and been given several dates which they say MBNA have been required to respond, each has been ignored.

    The annoying thing is that we had a Virgin credit card(also MBNA), taken out at the same time and also containing PPI, this claim was not disputed even though it was taken out under exactly the same circumstances.

    I think the fact that the MBNA claim is for three times the sum may have something to do with this though

    Basically exactly the same as I got in my letter! They were supposed to respond by 12th dec.
    My MNBA card was virgin cc.. Is yours the same?

    Hi Simon, my card is virgin.. Interestingly enough I had a very simular situation with Egg, I had an Egg visa card and then a year later I opened a egg MasterCard which I took out in exactly the same way, my MasterCard claim was upheld and I got back money the but the Visa was rejected! Bizarre I couldnt understand it!!

    I've also got a Barclaycard rejection with FOS as well but that seems to be taking forever!!

    I e-mailed them again this morning, not holding my breath.
  • Slight correction i mixed up the cards, like you they re-payed my MBNA card but ignored the FOS decision on the Virgin one. I wonder if that is significant ?
  • Just an update from my OP. Have written to MBNA just prior to Christmas giving them 14 days. As yet no reply. Next step will be to speak with FOS to find out if they will enforce. If not I will be going to small claims court. Let's wait and see, I shall give them until the end of this week to reply. Hmmmm....For some reason I am not holding my breath!
