Car insurance help needed urgently

Hi there.

I am a new driver And I purchased insurance through ingeine car insurace to lower my insurance costs as they fit a telematic box.

Also I thought but after I purchased the insurance and payed the initial deposit I had no further contact from them and on Friday I got stopped by the police who seized my car and gave me a fixed penalty notice that includes 6 points so I will be banned a 200 pounds fine plus cost of recovery of the car the next day I contacted ingeinie who said that they had canceled my insurance due to not being able to come and fit the telematics box.but they never informed me I was furious when I heard this and demanded they passed me to a manager who denied all knowledge of me having insurance now I am facing a ban unless I can goto court and prove my inicence which I can't due to the insurance company being un-cooperative

  • Hi yes I paid them but I never recived a cover note they said they would send all documents through the post

    I'd be inclined to start recording things sharpish....if you paid them then you did have insurance and the mechanism for cancelling will be in your policy but invariably involves a letter to your home giving 7 days notice.

    If they are claiming you never had insurance then that shows an error in their system and that error could have caused the trouble you are in. If this is the case you should be ok

    $Hopefully, you will have actual proof of payment.

    Their website says the box:-

    will be fitted within 2 to 3 weeks but don't worry you are insured from day one.

    Time for a complaint I think.

    Their T&C allow cancellation as above so if you did actually pay then you are ok as even if they had sent the cancellation on last Wednesday it wouldn't have come into force until next Wednesday.

    How did you pay? How did you take out the policy? Any written confirmation/communication from them? Any proof you did actually pay?

    Did they agree to provide cover from last Wednesday or did they say cover only started once the box was fitted?

    In normal circumstances insurers have to give 7 days notice before cancelling a policy; which you haven't been given.

    You should have been given a policy booklet, or, if bought online, been able to download one. What does it say about cancellation?

    You will need to buy another policy to get the car released, and you may need to declare that you have had a policy cancelled.

    What date did the insurer say cancellation was effective from? You may have been still covered on Friday when you were stopped. If so, they should still issue you with a certificate or cover note for the period they covered you. The police should have asked which police station you wanted to produce your documents at, and issued a form HO/RT1 (although the form is just a reminder and doesn't serve any legal purpose). Take the certificate to that police station and ensure the counter staff record the insurance details. Then ask then how to get the fixed penalty note cancelled - you may have to write to do this. As long as you were insured you can't be prosecuted, and as long as you produce the certificate with 7 days you can't be prosecuted for failing to produce either; but you need to ensure that you tell the police that you were covered.

    Did you tell the police officer that stopped you that you have only just bought a policy, and tell them who from, and their phone number? If so, they should have taken reasonable steps to check with the insurer whether insurance was in place before seizing your car. If not, you can question the legality of the seizure (provided you were actually insured at the time) and ask the police to consider paying your seizure and storage fees. Some people on these forums have successfully challenged them and been refunded.

    Separately, you need to register a complaint with the insurer about the cancellation and escalate it all the way to the Ombudsman if necessary.

  • Hi thanks for all the help the insurance company inquestion do not want to know about the matter and have said that they will send no proof of insurance it was a very rude person I spoke to and when asked to speak to a supervisor I was cut off so with no proof and them not willing to give me any I can't see anything I can do to prove it the police did not even phone the insurance company they where just adament I didn't have insurance and ordered the car to be seized
