You need to check with your council but I think priority is usually given to the parent and child combination.0

your council may wait and see who has custody of the children. A lot depends on the tenancy agreement and the council policy - so you need to ask them.0

Don't want to sound judgementall, but with a 2 year old and one unborn child, could you attempt to work a little at the relationship, possibly with external help such as relate or other services.
Nobody ever said it was easy, but with such a young family, it should be worth a try.I lost my job as a cricket commentator for saying “I don’t want to bore you with the details”.Milton Jones0 -
It's not the council's decision. If you're joint tenants, it will be up to a court to decide. Locally, the council won't even advise on this issue- they just suggest you see a solicitor.
Be mindful though that they'll want to limit their duty to rehouse either of you.Only dead fish go with the flow...0 -
If neither of you are moving out, nothing will happen. You only need to change the tenancy when one of you wants to move. Then the answer is "it depends".0

If you're both wanting the house then you will need a solicitor. Normally the PWC will be awarded full tenancy of the property, but Niall likeliness it will be a court matter!0

Weren't you both involved in creating the children? Aren't you both responsible for them? If he doesn't think he is, maybe he needs reminding about his responsibilities.
I'm not suggesting it will necesseraly work; but if you don't even try, you can never know.I lost my job as a cricket commentator for saying “I don’t want to bore you with the details”.Milton Jones0
