I am at the stage where court is the way to go with Barclaycard,:mad: I haven't seen a thread quite like mine so I thought I'd start one.
I have followed Martin's article on Credit card charges to the letter and seems Barclaycard aren't budging. Their last 14 days to settle expired Monday and cos I have been busy with work I have not been able to follow up. Not even a letter to say "Hi we are looking at your case" Nothing :wall:
I read somewhere that I can email the CEO with details of your claim as it worked for some, any one done this? I am contemplating this as my next step or straight to court.
Any advice would be greatly appreciated.

what reason ar they rejecting your claimDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

Well I got the pretty much standard letter that the "charges incurred were made correctly and in accordance with our terms and conditions"
One of the things I am irate about, looking at my statements, my limit was reduced to 750 which then took me over my limit and consequently brought about a litany of various charges, all of these I intend to claim back.
All of these are of £12 types, they even included a leaflet urging me to contact the ombudsman. I suppose that standard too, so I decided to forge on, intending to see the end without the ombudsman involvement, if i can help itBarclaycard £750 - Awaiting refund;)0 -

Can you clarify the above, they reduced your limit to £750 despite your current balance being over £750?
Or did they reduce it to just above your outstanding balance and then further spending, fresh interest etc took it over limit?0 -

You can more or less forget the FOS now. Apparently, all the card providers have justified their £12 charges to the FOS. So, court is the only option for you now.
Just to be clear on the credit reduction as that actually may be a complaint in its own right that the FOS would look at and not fall foul of the justifying charges levels. It is very unusual for card provider to reduce a limit below the borrowing outstanding. That would almost certainly be an auto uphold decision by the FOS and the complaints team. Are you sure they reduced your limit below your outstanding balance? It didnt get taken above from transactions in pipeline or similar?
Was the reduction in limit out of the blue or something warned about in advance?I am an Independent Financial Adviser (IFA). I can't remember seeing a letter to that effect as I have mostly keep such information judiciously, and Yes it did tip me over the limit as my statement confirms.so thanks will be heading to court on this one.

I wouldnt rule the FOS route out yet. If you want to go with unjustified charges, then, yes, forget it. However, if you want to go with charges being levied due to unfair reduction in credit limit with no warning then you have a much better case using the free of charge complaints process. They key thing is not to focus on the charges themselves being unfair but the actions of the bank that led to the charges being levied in the first place.
