    Ignore Happy Trickster's advice - he's Mike Perkins who works for Combined Parking Solutions a PPC !!!! Strangely, Combined Parking Solutions were recently banned from accessing DVLA data because of gross misconduct.

    So it is the landowner, not parking eye, who has the power to grant the right to park?

    If they can't grant the right to park, they can't refuse or restrict the right to park.

  • I replied to the ParkingEye along the lines I borrowed from few examples here and on Pepipoo. I have now received a 1.5 page letter from ParkingEye, which looks like it has been specifically drafted rebutting points made in my initial reply. There is no mention of POPLA but where I have referenced HMRC vs VCS and VCS vs Ibbotson, they gave some legalise arguments why these are not applicable.

    I'd like to get some views from experts but do not want to post as this letter looks very individual.

    Email or write to them and demand the popla code, tell them they must supply it within 35 days or it will be automatically dropped per the code of practice from the bpa. Also tell them that you have referred their letter to the dvla as they are not compliant by not referencing popla or making mention that there is an independent appeals process they are disregarding.

    If they don't drop it I would be amazed.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    My understanding is that there is someone at London Councils who is monitoring the PPC's compliance with the POPLA process, and I'm sure would be interested in learning about any appeal rejections that do not supply the POPLA code or details of how to appeal to POPLA.

    There is no need to do that, just forward the letter to popla and the dvla, they will decide if there is a problem with the letter, by your description there is. The email address for the dvla is below for you
