Will I get a refund?

Hi I wonder if you can help!

I purchased a Bosch integrated washer dryer off ebay. It was marked as used and in mint condition - only used a few times in 2010 - been in storage since then.

Great I thought, was not in the slightest expecting it to be in perfect condition. However, picked it up today and there was a fair bit of rust on the base. I didn't complain as I thought it is superficial. Since plumbing it in I have tried to do 3 washes - all have failed towards the end and the machine is showing an error code :(

It was too late to phone tonight but am going to tomorrow and would like to know where I stand with getting a refund? I will happily return it (15 miles) but want all my money back (£225 so not cheap!) Can I request this? What happens if he objects?

I feel sick at the moment! I really can't afford to lose the money and have no washing machine either! I paid cash :(

    Seems a lot of money for a rusty washer dryer. Comet would have snatched your hands off.

    I bough a second hand dishwasher that was described as new and unused. It was delivered at night and was anything but.

    Only cost £50 - but guy refused a refund.

    However, he delivered it in a Council van - and when i said i would ask them for a refund - he said keep it and gave me my cash back. Its still going strong now.

    They could say sold as seen - but its not as described and you were not given a chance to see it work. See what they say first. Was it a private sale? Even then, it could have been bought to sell, without checking it worked.
  • Thanks for the reply! Yeah it was a private sale, went to the guys lock up to collect it :(

    The OH thought it was a good buy as it was Bosch, still expensive though when it dowsnt work! Will phone him tomorrow, really hope he lets us return it, then I might make that trip to comet :)

    If they refuse - and you have to be prepared for the fact that they might - then you may still have recourse.

    eBay will entertain claims when the item is such that there is not usually much ability for a buyer to see it working when they pick it up. Not sure whether this requires you to have paid by Paypal, however.

    You could also take legal action: that is not conditional on rejecting the item when it's picked up, for the same sort of reasons as eBay but more generally.

    Yet you still handed over £225 cash?

    Did no alarm bells ring when you saw the lock up garage and that rust? They should have.

    Normally I would say that your chances of getting a refund are fairly low. However I have had a look at the seller's history and feedback (it was easy to find) and you might be lucky. She appears to be a genuine occasional Ebayer and not a scammer.

    Make contact and see what reception you get. Be nice and don't go in heavy handed.

  • Hopefully the seller will agree to refund voluntarily. Maybe it was in mint condition and working order when they put it in the lock-up and they hadn't realised that this was no longer the case (damp problems in lock-ups aren't uncommon).

    Managed to get in contact with the seller and explained the fault - have sent him a video of it. He seemed adamant that it was fine last time it was used so we argued that we could hardly have broken it in less than 24 hours!

    He is going to investigate it tomorrow and wants to come out and see if he can fix it! Not happy about this but didn't have much choice so agreed hoping that when he gets here he will take it back and give us our money back!

    To top it all the damn thing managed to flood the kitchen so we have had to put it in the shed which I'm sure isn't going to do it much good!

    I wish my OH was stronger I would have said no when I saw the rust! Damn weak man!

    Will let you know how it goes tomorrow.

    Always go and pick up stuff yourself.

    99% of the time it works OK (had kittens when I found my mum and dad had collected an old meccano set from someone who lives near their second home on behalf of one of their friends up here, without the buyer themselves being able to inspect it) but ...there's always that 1% of times where it goes wrong.

    There may well be a legal route you could go but it involves a long wait for a court date - there is a case on the buyer's board that began in the early summer and the date has been fixed for February. You also might have difficulty getting them to pay up.

  • Update from today -

    Seller did not ring me as promised to arrange time to come and view the machine tonight. Phoned him at 4 to double check - he is now 'busy' :mad:

    His solution is that he wants to take the machine away on Wednesday and get his mate to have a look at it and fix it - because it apparently cant be anything big as it was working 2 years ago when it went in to his lock up!

    OH stated that if this was to happen then we would want our money back while he took it away and maybe it was easier for him to just have it back and re-sell it on ebay after it is fixed.

    Seller is not happy with this and says that he has already spent the money and has nothing that he can give to us apart from his word!:eek:

    Not really sure what to do as I certainly don't want to let him have it back without my money being returned - I may never see the washer or my money again!

    I am going to phone him back but thought I would ask you lovely people for any advice on it. I am tempted to say that I will open a case with ebay (although I know I dont have much recourse as I paid cash) and threaten him with small claims court.

    Or say that I will get it fixed and that he can refund me the cost - or I would try the small claims court route.

    I know they are all quite empty threats though as I am not sure I'd win :(

    It just annoys me as even when I have been desperate and sold stuff on ebay I make sure I can return the money until I know they are happy!

    Dialogue is always better than threats.

    You *may be lucky with an Ebay case, they do sometimes intervene with COC purchases. But ultimately you handed over the money. It's harsh but true and I'm sure you wouldn't do it again.
  • Haha you can be as harsh as you like it's true! I most certainly wouldn't do it again!

    I don't want to make threats I just want it resolving! Should I tell them that I am going to open a case and see what they say?!

    Paypal all the way in future!
