Property Management Company has fired parking enforcers but they are still working!

    I was originally clamped in December 2011, I had taken down my permit to park in the visitor spot outside my building (I had a weekly shop to get up to my flat and didn't want to tackle the underground car-park stairs) and forgot to put it back up when I parked in my space. I had an argument with him stating they had my registration number on file and so they knew it was my space (we own our flat), he stated that my car was unremarkable and so he never noticed what parked where and that the management company don't give residents registration numbers to check as it would take too long. As there were plenty of notices up all over the car park advising permits must be displayed or you will be clamped I just paid it.

    The second time he clamped me was January this year. I borrowed my Dads disability car and left the permit on the dash. Force of me closing the door made the permit slip down ever so slightly so that the expiry date was hidden by the windscreen rubber. As I mentioned before, none of the permits were due to expire for several more months as it was a new building with new permits. Seeing as my Dad's car has disability badges and stickers all over it I couldn't believe it had been clamped as a mere 5% of the permit wasn't visible.

    When he was confronted I was told that the whole permit had to be fully visible or else residents would be clamped (although 6 weeks before this he told me that he always checks that permits haven't slipped down or fallen on the floor before he clamps a car!). We were warned that removing the clamp would result in legal charges as it was damage to his property.

    I could try and recover the £260, but seeing as he seems to have shut down the business that issued them, I'm not sure how far I would get. Plus with legal fees etc I am bound to end up out of pocket and super stressed to boot.

    You need to issue a joint claim against the Company AND the person who applied the clamp AND the Management Company in charge at the time. It is up to you if you want to add-on costs to cover research and lost interest etc.

    Both could be recovered in a single small claim, no Solicitor needed, costs around £50 which you can reclaim, along with interest at 8%. But you'd be suing whoever contracted the clamper there, as well as the clamper; it's the managing agent who would have to pay up for the actions of their agent.

    The clamping of a disabled person's car is/was an unlawful clamping, in breach of Rippon's SIA licence at the time. Clampers were never allowed to clamp disabled people's vehicles for any reason. Illegal. You'd certainly win that amount back in Court and should win both clamp release amounts back.
