Carrington Carr - Looking Grim for Pre 2004 Policy Holders

We have just received the following letter from Legal General & General in relation to a PPI policy costing £7171 and sold to us in 2003 by Carrington CarrLimited. Does anyone know if there's anything we can do now? Do we take what Legal & General are saying on face value? Is our claim dead in the water?

"Thank you for your recent letter. I'm sorry to learn of your dissatisfaction.

Unfortunately we are unable to look at you complaint. Carrington Carr (formerly AWD) were solely responsible for any advice given on this type of of product orior to 31 October 2004, We have no infirmation on the advice given to you.

Normally you would be able to ask the Financial Services Compensation Scheme (FSCS) to look at it for you, as Carrington Carr is in Administration. However, we have been told the FSCS will not look at it, because your policy was sold before this type of product became regulated.

You could pursue your claim through the courts but we understand from the Administrator that there are no funds to settle claims.

If you have any questions about this, please contact the Administrator.

    Yes. Its time to give up.

    It's accurate if that is what you mean.

    Your comlpaint is dead.

    L&G have no liability for the advice given (remember its not the product you are complaining about). CC gave the advice. You would complain to them. However, they dont exist any more. So, you cant. There is protection for those that bought after January 2005 but not those that bought before.

    So, you have no-one to complain to. Therefore you complaint process is over.

    We have the same problem. PPI was through Adminicle Ltd which is now handled by Assurance Services but they do not handle mis sold PPI and referred us to Carrington Carr liquidators.

    Like you would welcome any suggestions to claim.

    Can you provide details as that totally goes against the FSA position and doesnt seem logical either. I suspect you are mixing things up. Whilst there is a window that can see some pre 2005 complaints see the insurer liable that does not apply to MPPI. Mortgage brokers would rarely use the bank's product and most had a panel or whole of market where they represented the client and not the insurer. So, the insurer would not carry the liability. The ones that do seem to have limited success are loan brokers.

    Absolute rubbish. Your partner works for a bank. They would have been members of GISC. So, they have to consider pre-regulation complaints.

    As far as I'm aware, FSCS go by the purchase date, not end date.
    Are you saying this has has now changed, do you have a link to where FSA have said they should cover these polices now?

    You cant just claim insurance premiums back because you havent claimed on the policy. There has to be some wrongdoing.

    Ignoring the fact that life assurance is not PPI, what wrong doing are you alleging? When was this?
