even comes out of your bank with an expired bank card!!!
continous payment agreements dont need an expiry date on a card.

I had an AXA policy and the auto renewal was quite clear on the renewal letter and it told you what to do if you didn't want it to renew. All you have to do is read it.

You mean other than in the terms and conditions you agreed to when you bought the policy AND the letter they sent you to advise that if you do nothing it will automatically renew

And what did the renewal letter say?
Censorship Reigns Supreme in Troll City...

  • Its not just AXA, the AA, Aviva and so on are all moving to Continuous Insurance.

This is because the law has changed, you are now required to have Continuous Insurance (CIE) on all motor vehicles you own, even if they sit doing nothing in your garage.

But AXA may be doing you a favour as DVLA are nasty worded letters out as well as fat fines. Beware!

The change of the law is not down to the insurance companies to enforce. They have no idea if you have SORN your car......
Some seem to be using it as a excuse.

Strangely other insurance companies (Rac & sainsburys) are moving away from auto renewall.

DVLA, cannot fine you.... They can only request you pay their charge. Unless they take you to court.

  • I too have just been caught out by Axa in the same way - my car insurance was due for renewal on Nov 1st 2012, and when I received a "Your card has expired - please log in and update your payment details" I assumed that if I didn't update them, that they would be unable to take the £460 for the new insurance, and thus wouldn't renew my insurance. I went with Admiral in the end, only to find that Axa took £460 out of my bank account, leaving me "double insured" for a fortnight; Axa now are asking for £100 to refund my money.

Whilst I understand the principle of autorenewal, and that Axa told me it would be happening, I feel misled by this whole "continuous renewal" malarkey and by the wording of Axa's emails: if they had said "your payment details have expired but we'll STILL be able to take money from your account unless you EXPLICITLY cancel" that would have been much more honest. There was an implicit "you need to update your details in order for us to charge you" in their email that feels borderline duplicitous.

You may be able to avoid the cancellation fee if you can prove to AXA that you were "dual insured".

Ring them and explain the circumstances - they might request that you send proof of dual insurance.
  • I assumed that if I didn't update them, that they would be unable to take the £460 for the new insurance, and thus wouldn't renew my insurance.

Assuming they had been unable to take the funds it wouldnt have stopped the policy renewing it would simply mean the policy renewed and you failed to pay for it.

If you didnt make amends they would then cancel the policy for non-payment, potentially pass it to debt collectors and you'd have a lifetime of having to admit a policy was cancelled and so at least triple premiums.

Cancelling payment is not the same as cancelling a service!
  • Last year I paid for my wife's insurance out of my own account to Insure, this year I paid again automatically, I didn't even know I was doing it this time. Be warned.

That is perhaps a discussion you should be having with your wife.
