1. The AA that is now coming in is being overpaid - this will have to be paid back. To continue receiving it could be classed as fraud.

Well maybe tanith and skintandscared are both right, but he is Skint and Scared, and I dont think suggesting they 'thow the book at him' is in the spirit of the MSE Forum
Not everyone on here has disposable income, savings and an ability to deal with the bureaucracy of our benefits system
Jobs are few and far between and his business is a shop with him living above it

His parents need to pay not him, if he is that much of a despicable human being to put the blame firmly on his parents rather than being a decent human being why are you bothering with them? There's not many that stoop that low.0 -
Accessing his parents' bank accounts without POA is wrong for a start never mind that the AA should stop after 28 days so there is already an overpayment. The DWP need to be informed right away so as to minimise the overpayment as much as possible.Lost my soulmate so life is empty.

He does not have POA He sees that as creating a link that he is responsible for their affairs.
I know this all sounds like 'head in the sand' but I know his position and was just wanting to see if anyone had suggestions for avoiding payback

Yes, the DWP will want the overpayment refunded, and I don't know what repayment arrangements they'd suggest while the OP's friend's parents are still in hospital; but in my experience they deal very sympathetically with late notification of a long hospital stay.
My mother was in hospital for 3 months; when I rang them after she was discharged, they quite understood that I hadn't thought to inform them earlier; they simply arranged to take back the AA overpayment by reducing her future payments by £3 a week for as long as it took.0 -
They'[ll be chasing his poor elderly parent for the the overpayments.
