Faulty HTC ebay purchase

Hello, I was wondering if anyone could advise me on a ebay purchase I recently made. I bought a refurbished HTC phone from an ebay shop, for my wife for her birthday. When I received it I noticed there was very slight pixelation discolouration in the bottom right of the screen - which unfortunately I just ignored.
Within a couple of weeks the screen went black and white (still functioning and all icons visible - just colourless) with a couple of millimetres of black and white lines on the bottom of the screen.
I contacted the company and they said they'd collect it and offered me a refund/replacement. They've now sent me an email saying that the phone has been knocked or dropped which has caused the damage and it's not covered under the warranty.
Now I know the phone hasn't been dropped and it was returned to them, securely packaged in bubble wrap. I have sent them an email requesting photographic evidence of this alleged damage and am awaiting their reply.
I would just like to know what would be the best action to take, as I think they may be trying it on, so as not to sent me a replacement. Any help on this matter is greatly appreciated,

Have you raised an item not as described dispute through EBay? You have to do that within 45 days of the purchase date in order to get your money back, you will need to have sent the phone back tracked with a signature to get a refundDebt free and staying that way! :beer:0

Hi thanks for the reply. Would reporting it to ebay work, as the phone was fully functioning when I received it and only developed the fault a couple of weeks after??0

Thanks Sparky93, will give that a try. Will give the shop until tomorrow to reply and if there's no happy outcome, I'll contact ebay!!! Fingers crossed.0

Raise a dispute asap ifits not your fault ect. I dont think people on ebay can refuse returns ect but im not an expert lol0

How did you pay? eBay won't intervene, but PayPal are excellent to buyers if you are within their timeframe. Unfortunately, your rights are limited as any Pre-existing issue needs to be challenged at the time, not weeks later - as the prospect of user damage being passed off as Pre existing is greater. It then becomes your word against theirs.0

What HTC phone is it? They have a 24 month manufacturers warranty, so there is a good chance that HTC will fix it FOC.0
