mobile phone contract cancellation

If they were two parcels they would be tracked separately (separate tracking ID) and each would require a separate signature.
If you only signed for one parcel, then they only have evidence that you received one parcel.
It is their problem if they incorrectly sent out a second phone and it was lost or stolen en-route.
Someone may be using the second phone to run up huge bills, so they should want to sort it out ASAP.
You signed one contract, received one phone, signed for one phone, so you only pay for one phone/contract.
Claim on the direct debit guarantee for anything they debit from your account in relation to the second phone.
But you need to keep pursuing them through their complaints system, dispute system etc until the matter is resolved. You need something from them in writing to say it is resolved and you don't owe anything on the false contract (and you should keep this letter for 6 years just in case they change their mind later or sell the "debt" to debt collectors).0 -
cheers for that sounds promising0

Until the matter is resolved in writing:
Keep notes of all phone conversations with them on this matter (with dates and times of calls.)
Send all letters recorded delivery (and keep all receipts for postage etc)
Keep copies of all emails.
If you think the phone is being used fraudulently by someone (as opposed to non-existent second phone resulting from a glitch in their system), contact their fraud department as well or just contact them anyway for good measure.
These companies are not always joined in terms of different departments0 -
You haven't checked your bank statement since July 2010 then? And you didn't miss the £1015 that has been erroneously taken out since then?
Was the contract you took out in July 2010 an upgrade or a new contract? You say you 'changed' your contract-what does that mean?A new contract is just that-it doesn't cancel your old one. An upgrade obviously does.No free lunch, and no free laptop

So, if you took out a new contract (still not clear from your account above), that does not cancel your old one.
No refund on that basis, if you failed to cancel.
But don't you cancel your DD's when you conclude a contract? No free lunch, and no free laptop

But it sounds as if the OP was completely misled about what was happening and the consequences.
Even if harder to prove, worth going through the disputes procedure, regulator etc for that much money.0 -
