    It says it is stalling intermittently, which would suggest that it is not the rider

    I did not say the rider caused the bike to stall.
    Just that the engine cutting out should not cause a competent rider to fall off.

    This. Even though it's clearly a fault, if you're a good rider you should be able to remain on the bike in the event of a stall.

    Having been thrown-off a bike when it stalled and the engine stopped-dead without warning, I can sympathise with the OP.

    As it is clear their insurance don't want to know, I would suggest speaking to a no-win, no-fee Lawyer. No harm in trying for compensation. After all, the OP stated that the bike's makers are recalling a model with stalling issues and in the world of motorbikes there is a good chance the same engine/ECU is used across multiple models, so there is a high probability that even though the bike is a different model, it might share the same power unit.

    That's irrelevant.

    If (and I mean if, it's not proven) the injury was caused by a stall, which was caused by the negligence of the distributor, the riding ability of the OP isn't the concern. See the 'thin skull' rule.
