If you fall off a motorbike purely because it stalled, you are not fit to be riding one.0

raised concerns with destributor on several occasions about new motor bike stalling intermittently. They downloaded new 'mapping' and said fine to ride. However stalled again, fortunately at low speed, but caused rider to fall off breaking finger, significant bruising/abrasions to both legs and damage to bike. Can't claim on insurance as 'mechanical' fault and destributor and manufacturer denying any responsibility. Significant distress and costs involved with arm in plaster, taxi trips for hospital appoitments, costs for replacement torn clothing, bike repairs etc..........WHAT can be done to get redress, bike repaired and costs reimbursed? NB the manufacturers website states that certain models have been recalled due to 'stalling' problems, but they say this particular model is not one of them. Any suggestions gratefully received!
Contact a personal injury solicitor. This needs much more specialist knowledge than you are going to find on this forum.0 -
Having been thrown-off a bike when it stalled and the engine stopped-dead without warning, I can sympathise with the OP.
As it is clear their insurance don't want to know, I would suggest speaking to a no-win, no-fee Lawyer. No harm in trying for compensation. After all, the OP stated that the bike's makers are recalling a model with stalling issues and in the world of motorbikes there is a good chance the same engine/ECU is used across multiple models, so there is a high probability that even though the bike is a different model, it might share the same power unit.Never Knowingly Understood.

If (and I mean if, it's not proven) the injury was caused by a stall, which was caused by the negligence of the distributor, the riding ability of the OP isn't the concern. See the 'thin skull' rule.0
