    No, and it's not a fine!

    We have seen Motability cases before and the fake PCN letters go to the registered keeper. Is that you? If so, you can of course ignore the letters.

    If the registered keeper of the car is your mother why not email a quick appeal saying you were driving and that your mother is disabled. However you know that the Blue Badge scheme does not even apply on private land so they are discriminating against disabled people to insist on it - especially when it's clear from the Tax Disc that it's a Motability car.

    But to resolve the matter, in order to get the ticket cancelled, you are enclosing a copy of both sides of your mother's badge and expect the matter to be closed now that they know your passenger was indeed disabled. Say that if they reject your appeal then you will require a POPLA Verification code to take the matter to an independent appeal as they cannot break the law now that they know about the genuine disability.

    Copy in the email address of Asda Customer Services and add a final paragraph requesting a 'reasonable adjustment' (use that exact term) to avoid any repeat of this farce which has worried your mother no end. Their parking agents who should know a Motability car when they see one, a quick perusal of the Tax Disc for the word 'disabled' and the zero amount '0.00' is a more valid check than looking for a Blue Badge when the scheme is not applicable in private car parks at all.

    Ask Asda specifically for the car reg number (give the car reg) to be added to Asda's list of disability cars for that store and other local Asda stores. Say that you know that some Asda stores are keeping a list to ensure that genuine disabled customers are not harassed in this way and so you require that reasonable adjustment to be applied immediately to your car because this harassment is unacceptable and unlawful.

    You are still treating this as if it is somehow legitimate, and you've been a naughty boy :-)

    However, you need to act if the motability car is registered to someone else, e.g. the motability scheme people. Although they are under no obligation to pay up either, some leassors are (rather surprisingly) not up to speed on these scams, and pay up, passing on the charge and a nice fat admin fee to the driver.

    This is where an appeal may be worth while to divert attention away from motability. You can still ignore with impunity all the junk you then receive.

    At first I thought it was just another spam message but I'm glad you posted it. Duly signed up. I suggest you also post onto pepipoo.com and Consumeractiongroup. Start your own thread or no-one else will see it.
    You could also put this elsewhere on MSE as not everyone reads the parking forum and it will get lost tagged onto the end of a current thread and few people will see it.
    Maybe ask Mr Crabman(mod) to move it to one of its own.

  • Hey guys a quick update. I appealed with the points you guys said and today recieved an email from tcp stating that the charge has been cancelled. Yay £40 saved

    I just looked back to remind myself of the circumstances and of course, they had no leg to stand on with this fake PCN. Just reminding you that you started off on here thinking you'd broken the law but then realised that the PPC would have been if they hadn't cancelled it!

  • Yes they do make you feel to be in the wrong but when challenged the soon back down.
