Hi guys
Just after your opinions on this subject, I read alot about ignoring the pcn but Ive done something silly and am know getting worried.
I took my disabled mother to the asda for her weekly shop in her mobility car and parked in a disabled bay as normal, but i didn't display the blue badge because im silly and forgot.
Now my question is because I actually did break the law by not displaying the badge can TCP actually enforce this fine (invoice).
My Mom is happy to pay it but Im not sure I want these scammers take what little she has.
thanks for your help guys

You have NOT broken any law, you might have upset tcp but thats not important. Just ignore any bits of paper you get, they will try to make them look official and frightening but thats just to try to make you pay. File them away and don't worry.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

The Blue Badge Scheme does not apply on private land. You haven't broken any law.
All you've broken is some silly unenforceable rule that TCP made up in order to maximise their opportunities to scam people out of money that they are not legally due. In fact, TCP's silly legally unenforceable rule could be said to breach the Equality Act 2010, so THEY are the ones that have most likely broken the law, not you.
Ignore everything they send you. The threats of court and Debt Collectors taking your telly are all absolute rubbish designed to scare you into paying. You legally owe them nothing whatsoever.Je Suis Cecil.0 -
Thank you Peter I thought we had to display but maybe not0

thanks manxred it does seem wrong to target disabled people for parking in disability bays.0

It is best to display the badge, if only to upset the ppc.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

this charge is simply FAKE,,nothing can/will be done as a result,,only a PENALTY charge is genuine, not what you have,,ignore all threat o grams you may recieve, relax, chill, feet up now,,do not pay a SCAM.jobs a belter eh.imagine in court, now mr judge these people will not pay our FAKE ticket,,,judges reply,,,well you can guess the rest, thats why nothing will happen.0

I normally do but completely forgot this time0

doesnt matter its still a SCAM.0

I thought it was just didn't know if being a disability bay and a mobility car was different. i am also worried that they will go to dvla for the owners details and fine the mobility scheme.0

you did not break the law
they do not have the power to 'fine' anyone
who is the registered keeper (RK) of the vehicle?
If its not you or your mother you should make the Registered keeper aware, in some cases with lease/rental vehicles the rental/lease compnay pays up ( even though in 99.99% of cases its against their terms and conditions) if this happens dont worry, as you should be able to recover your costs/stop the payment.
Heres what to do:
Wait for first contact from the parking company demanding that you pay £XX.
Reply by telling them the truth, and that you forgot to display the blue badge, include a photocopy./scan of the badge as proof if possible.
Wait for the your apeal has been unsuccesful you now owe us £XXXX blah blah blah balifs may be called blah blah blah credit rating may be blah blah blah.
Next fire off a letter to that ASDA store as well as the parking company stating that you consider these letters to be harrasment, and remind them of their dutys/responsabilitys under the equalities act,
And if the letters ( the letter chain will progress to debt recovery agents then solicitiors) do not stop with imediat notice you may ( may - that magic word again) consider taking legal action against both that ASDA branch managed by <name of manager> for harrasment, and a breach of the equalities act, and that you would also like re-asurances that this will never happen again, and to prevent this from happening again maybe that ASDA branch should remove TCP parking from that site with imediate notice.
The shoe is well and truly on the other foot so to speak, and it is that ASDA branch, plus their agents TCP parking( for whom they are responsable for) that should be worried about a 'fine'From the Plain Language Commission:
