Parking Charge Notice and confusion over the new Protect of Freedoms Act

  • Hello I have read most of the threads on this forum and a few others and just want to check in and let you know that I am on phase 2 after parking on a service road behind a Sainsbury shop. Phase 2 is the dreaded controlaccount letter asking for nothing less than £105 after missing the pay £60 penalty letter from Euro car parks.

    What did I do wrong? Park for a few seconds out of the way on a service road not obstructing any traffic and no demarcation lines on the road to indicate that parking was prohibited. But admittedly there was a sign up on the other side of the road. On my Euro Car Parks PCN it states that I was parked up from 14:05 to 14: 05 which in my estimation makes for a very expensive few seconds of parking. I did not appeal or respond as every where I looked people just said the usual: ignore and make paper planes with it.

    However I thought I would just show my face in case someone on here thinks it might be better to appeal given that I probably have a good case to argue as according to their own PCN I was literally only stopped up where I shouldn't have been for a few seconds. Or perhaps what I am looking for is a little bit of sympathy and camaraderie. Thank you for all the leg work that many of you have put in to helping out people like me who know very little about the law.

    You cannot appeal when a fake PCN is at the debt collector threatogram stage. You have to ignore the whole scam now until the letters fizzle out. SIMPLE. :)

    I have the full set of Control Account letters in my handbag from a fake PCN I ignored 5 years ago from Euro! Nothing has changed, Euro still have no imagination - same old letters and they never try Court either. I think Control Account have only 2 or 3 letters in their computerised template files so it will soon all stop.

    You'll miss 'em when they stop writing to you! :rotfl:

  • Reading various threads recently on various sites I see Civil Enforcement and another PPC have waited a long time before issuing County Court papers in the hope that the victim ("defendant") will have forgotten all about it by then and PAY!!!

    Make a note if you get a ticket, just in case!

    Also, Civil Enforcement might just about lose a decent-sized client very soon. Will publish on here if they do.

    So why not start your own thread? - You've been here long enough to be fully aware of the no-bumping/irrelevant posts rule and how to navigate the forums to find the current/up to date threads.
  • So the upshot was from not replying to their three demands for payment and threats of CCJ and bankruptcy and criminal record etc was that they resorted to phoning me many times. I usually did not answer or told them that I was someone else and that the person they wanted was away. However on one occasion I did answer and told them that I would like them to take me to court. The fee is currently at £150. Since ignoring their last few calls they have given me a two month break. But I did receive a photocopy of the original parking fine in the post with no explanation. And that was it. Who knows perhaps the next step will be a small claims court summons???!!! Thanks for your help everyone.
