GAME Grrrrr!

Last week I bought a black ops ll season pass for my partner as a birthday present. At the time I was unsure I was purchasing the correct thing as the man in the shop said it came in voucher form. So to make sure I asked if partner would be able to download all the maps that came out with this season pass and was told yes he would. So I paid the £35 and received my voucher.

I gave partner his present and informed him that he needed to go into the shop and read the back of the season pass box as it had some kind of warning on it about downloading single maps.
we got a shock when we went to the shop to look. The box was gone and he was told that his season pass was no longer valid as the makers of the game/or sony had put the price of the season pass up and it was now £42 so if he wanted to get all the maps he would have to pay an extra £7.

From what we can gather GAME were told that the season pass would cost £35 so started selling them as a digital download voucher for that amount before they had actually been released (apparently you normally get it in card form). Now the actual price has been set at £42 and they say we need to pay them and extra £7 to get what we already thought we had!

The guys in the shop said they can do nothing as it's not their fault it's sonys for putting the price up. We spoke to customer services who said the same thing. They said that at the day i'd bought a £35 psn voucher not a season pass. Although it was on the shelf advertised as a season pass and I checked at the till to see if this is what I was getting. We asked for a refund but were told that we couldn't have one as it was an electronic download. I would assume I hadn't 'bought a download' until I put the voucher code into the playstation and payed for a download with it.

What can be done? Surely I don't have to pay the extra
Any advice would be appreciated. Thanks in advance.

    Yeah that's the one. The season pass box was just like those with season pass across the middle in big letters :)

    Not sure if the downloads are different but I know from past experience that when pre-ordering, you're usually doing nothing more than paying a deposit to secure a copy. You're not actually buying the game itself. When you go to collect the game, they actually take the payment from the deposit with anything over as the remainder balance.


    What do the T&C's say in regards to pre-ordering and price changes etc?

    Hi Unholyangel, normally with downloads as soon as they have provided the link via email or logging in to a site it is deemed the service is provided and also exempt from certain consumer laws.

    I think it will be interesting what it says on the recipt as if it says a season pass I think they have a case, if it just says the name I dont think they do

    Its more UTCA/UTCCR I have in mind than DSRs :) Although under DSRs, if they lose their cancellation right when the service starts, details should be provided to the customer as part of the written information required prior to the service starting.

    And they're pretty strict on circumstances where price increases (while remaining legally binding on the consumer) are allowed - given they view price as the most important aspect for a customer (by they, I meant OFT). But of course that does rely on it being an actual payment for that item and not simply an account with credit that can be used towards that item.

    I'm not saying the OP is entitled to the game in question at the original price but rather that imo getting a refund is more probable than getting them to honour the deal.

    It's sweet FA to do with Sony - it would be Activision who make the game, Sony have no involvement beyond it being the system you play it on, they do not set the price for these products.

    Telephone Game's head office & speak to them, you're less likely to get a christmas temp goon there and tell them what's happened and see if they will sort it out.

    OP can you buy the season pass via the playstation network and what is the value of it ?

    If so can you not buy the £35 playstation network wallet and use that to buy the seasn pass from the Playstation store ?

    Dont have a PS3 myself so I could be wrong.

    What, exactly, does the box say? Does the box clearly advertise a "season pass" or does it simply say "£35 credit"?
