[FONT=&quot]Went to the Peel Centre Stockport today, it was dark and raining we went into a shop to ask if I needed to pay and display as I am a blue badge holder. They told me I needed to have a look at the sign by the pay and display machine. The machine was quite a distance from the shop but went to have a look, read the terms and conditions on the sign and decided not to park there but shop else ware, returned to my car and drove out. There was a piece of laminated A4 size paper stuck to the sign board stating that the car park was now controlled by ANPR cameras. Not sure how long all this took but it could have only been a few minutes. My question is how long do you get to read the terms and conditions before they will / can claim I agreed to them and should have paid and send me a PCN.[/FONT]

    The time considered reasonable by a court should be proportional to the length and complexity of the terms.

    Given that most PPCs make their small print as convoluted as possible, you should have a good case if they try to enforce any charge.

    Contract law relies on understanding and acceptance of a contract. Everybody has the right to refuse acceptance, so the plaintiff should offer reasonable opportunity to decline. To levy the full parking fee after declining and taking reasonable and prompt steps to leave the premises, should be seen by a court as imposing a "penalty", so should be grounds for rejecting the claim.
  • As it won't get to court, there's no need to worry. There are lots of reasons why, take a good read of the posts on here to cheer yourself up.

    Excel Parking I think. In truth the t&c sign was so long with writing so small that I was getting soaked by the rain trying to read it and gave up partway through.

    Excel are currently banned from accessing the DVLA database for 3 months.

    This means they have no way of knowing who you are and where you live.

    If they send you any mail it would be very serious for them.

    fear not morrisoscar,the peel centre is my patch, i patrol it regularly educating unsuspecting motorists of the scam,the signs are quite simply a joke, expel(excel) have in fact been ordered by a judge to improve these, but they have done absolutely nothing(google michael cutts),all that these clowns hand out are FAKE tickets/invoices,they imitate the real one,so worry not, jobs a belter,incidentally expel read this site daily, so if you get any pms with low post count, do not respond as it may be them in disguise,so its a 100% ignore.

    Hope you have taken this on board, OP. It means you won't get anything unless you give them your details on a plate by 'appealing'. DON'T!!!!!!!!:D
