re-land registry

Hi, because my daughter has no paperwork of the mortgage, or anything, he has it all locked away.kingstreet wrote: »From LandReg website;-

Details of the ownership of the property are contained in the proprietorship register. I would expect the tenancy situation to be shown there. There is a Land Registry representative who posts on this forum. It may be worth waiting for information from him/her.
If you don't mind me asking, what's the importance of the "tenancy" in the current scenario?
I don,t know how true it is, but if it,s TIC, then he has a better chance of doing what he wants with his half ? Less chance of court forcing a sale, but solicitor says it can be done.
Curiosity and proof basically, because he is such a devious person, never does anything straight.0 -
If there is a TIC aspect then this would normally be shown by a Form A restriction in the B Proprietorship register - take a look at our Public Guide 18 and section 2.2 for the wording.
The guide explains the importance of the two types of ownership from a leagl title perspective and as other posters have suggested will not reflect the 'shares' (if any).
kingstreet has copied part of the guide and provided the link as well. You would only need to check the land register (not the title plan) and this information would be relevant to your solicitor.
It is also likely to be important to check what paperwork was completed when the property was purchased, transferred into joint names and/or mortgaged. Issues of shares/trusts are usually discussed as part of the process and the solicitors who acted at the time may be able to add details to the mix for you.
IF the register reveals that it is a TIC then there is a slight chance that the share details might have been included in the details provided at the time of registration. If it is a TIC and you are unable to confirm further details then I would suggest you Contact Us by email with the details of the property/title and asking us to check if any information regarding the TIC was lodged when the changes were made. We would advise whether they were and if so how to obtain copies of any relevant paperwork.“Official Company Representative

That,s fine, it,s what the link says I will get for £3. I only want to know if it,s TIC or JT.kingstreet wrote: »Ah. Sorry, I thought you'd posted up the initial page.
I don't know if that's what shows on the Proprietorship Register, I've never had occasion to use it.
Daughter asked me if knew or could find out, got about 4 A4 pages about last remortgage, nothing on it really.
We are dealing with a guy who has bricked up the inside of the house, allowing my daughter to access only upstairs, while he has downstairs. My daughter cannot use kitchen, laundry, back garden, back door etc.police cannot act;he,s trying to force her out.0 -
Hi , Thanks for your reply... I have read the details regarding form A and all the other relevant data on that thread.Land_Registry_representative wrote: »If there is a TIC aspect then this would normally be shown by a Form A restriction in the B Proprietorship register - take a look at our Public Guide 18 and section 2.2 for the wording.

Without any paperwork we are only guessing at what she signed;
He,s self employed, and we know he obtained ficticious earnings to obtain the last remortgage, he has no books, paid no tax, NIC, ever. That was when banks were throwing money at you.
I,m afraid, my daughter was naive, we warned her,
Don,t know if it,s TIC, if he has set up any trust etc? for his half;
Trying to keep solicitors bill down by me doing some research of my own, difficult.
Very complicated. Will do as you say, thanks again for advice, much appreciated.0 -

Can't you just get a builder and unbrick it? Is he mentally unstable, is he abusive verbally or physically? If so have a family solicitor to get him out on that basis.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -
Hi Fire Fox..yes offered to do it myself, daughter won,t, even though the solicitor said she can,( JUST this week ) and me 6 months ago .He told her he would just rebrick it up;;;;;yes, anyone who does that isn,t right in the head;;;verbally yes. he has hit her once;;;trying to the last part. Can't you just get a builder and unbrick it? Is he mentally unstable, is he abusive verbally or physically? If so have a family solicitor to get him out on that basis.
nothings progressed since then, it,s got worse, should have let her go BR, and let them foreclose on the house, s, thought it was right at the time. wrong now;;0 -
Haven't ploughed through every word you've posted, but have you actually downloaded the Title yet?
Posting a 'sample' is pointless!
For £3, what are you waiting for.....!0 -
Is it possible for her to just walk away from it all and start a new life?
It all just seems a major hassle that's all.
Sometimes hanging on for small financial fruit is just not worth it.0 -
Hi G_M, done it, but aint much good.Haven't ploughed through every word you've posted, but have you actually downloaded the Title yet?

Obviously I cannot post on here, all personal. but it wouldn,t let me copy/paste anyway. saved and printed it.
Firstly it gives a Title Number.
Secondly it gives address
Thirdly it gives Stated Price ;;Not available
Fouthly it gives names of my daughter and OH and address
Lastly it gives Lender, Santander
That,s it, not even the price. No mention of tennancy
EDIT;;;second page, full property register.
1;;;she rented it from council when he threw her out of other home, with daughter, my grandaughter.
2;;;2004She purchased it for £36.5k
3;;2006;;registered charge
3;;;2010 proprietor;santander.

She cannot walk away from a joint mortgage, on the main house and one in spainmakeyourdaddyproud wrote: »Is it possible for her to just walk away from it all and start a new life?

She wants to, she,s trying to sell, so she can repay the interest only mortgage, It was repayment, he changed it to IO and cancelled the endowment policy ????He used her to obtain money for spain using her house as colateral, because he was up to his eyes in debt;;even more so now, but, so is my daughter.
She,s still liable for those mortgages if she walks away, if he dies, she,s left with them to pay.
I want her out of there asap, but, she/we are trying to be reasonable, but it isn,t working. That,s anathema to him.
She,s got a new lovely chap, but until this is sorted, they cannot make progress.0
